Domestic Violence Interview

Presenter: Good morning and welcome to SOFTtalk. My name is John Cayne and I’ll be your host for the next 20 minutes. Today in our studio we have a well-known person Alexander Smith you has come here to tell us about his opinion on domestic violence and particularly, since Alexander has been working as a district attorney, about the legislation on domestic violence. Good morning, Alexander.

Host: Good morning

Presenter: Please, tell us what you think.

Host: All right. Having worked as a district attorney for 15 years now and having mostly dealt with family issues I would like to comment on the issue of domestic violence and provide possible solutions to it. First of all, we should have a clear definition of what domestic violence is. This is very important since it should also include intimate partners and family members. It should apply to both past and present intimate partners, members of the same household.

Presenter: Ok, we have the definition, can you tell us something about ways of dealing with the problem?

Host: From what I have learned during the 15 years I have worked is that it is always easier to prevent domestic violence. An ounce of prevention is better that a pound of cure, as they say. That is why I am very positive about the legislation that supports this view; I believe this is especially critical. Very often there is this bias about domestic violence being a private family matter and not something that the governments and courts should be intervenening in.

Presenter: What is your opinion about protection and assistance to the victims?

Host: Also, protection and assistance to the victims should be provided in all possible ways. One of the focuses is the critical role of law enforcement. Police are on the frontline of the issue and they are very aware of domestic violence, they are acutely aware of the damage that it causes to women and children and the community. But they do need clear guidelines on how to deal with it. There seems to be a global pattern on the reluctance to intervene. Police do some kind of risk assessment at the scene of the assault, make sure they don’t have a very dangerous situation on their hand, a possible imminent homicide, that they transport her to a medical facility or a shelter if possible.

Presenter: We have just received an email and one of the viewers wants to know if you believe domestic violence cases should be prosecuted. Thank you.

Host: All domestic violence cases must be prosecuted. Sometimes the victims are reluctant to testify, to face their abuser during a trial, so some strategies have been implemented like evidence-based prosecution and absent victim prosecution where prosecutors learn to gather evidence that supports their case of a prosecution of an abuser without victim testimony.

Presenter: How successful have orders of protection have been?

Host: Oh, very successful. The order of protection allows a victim survivor to come forward and seek an order from a court and sometimes from law-enforcement which orders the abuser to stay away from the victim, sometimes to stay out of the home. The permanent orders can order things like alimony and child support and payment, and insurance bills. The legislation should include a possibility of emergency order that can be issued ex-party without a hearing. The victim can come forward and make a clear statement about the violence and get this order immediately. It has shown to be one of the most important legal remedies that we have found in these cases.
