A Case for the Prosecution of O.J. Simpson

Some people think that because the Defendant in this case is a household name, that perhaps he is someone above the law, that there ought to be special rules for him or that somehow he should be treated differently than any other Defendant. Well, that's wrong, that isn't justice. I'm here to ensure justice and we all know the rules. And the rules say and the law says that he should not kill, that he should not have killed these two people, and, jurors, the law says that if you believe that he killed these two people and if you believe that it has been proven to you beyond a reasonable doubt, that you should find him guilty. You’ve heard the evidence and you've seen the evidence, and you're reasonable people. But we know the truth, and the truth that we know is that he killed these two people.

I think we need to consider the Defendant’s real nature that actually backs up the truth. We can all agree that everyone thought this man to be warm, congenial, a happy-go-lucky guy, a Superstar and a model family man. He aspired to achieve a lot in life and he actually made a great career as a baseball player. He has been the second-great footballer in the US history. He also dreamed to become a good actor. I believe nobody can really deny the personal characteristics that helped him on his way, for instance being a big-time cooperator, socializer, a perfectionist, looking ahead, having personal charm and charisma. But the Defendant’s public image was far from his real self. We have heard the testimony that strongly supports the possibility of the fact that this man had killed his ex-wife and her friend. He was seen cruising bars, indulging in drugs at wild parties and philandering. That is the side he had been hiding. Another social factor that can suggest that he committed the murder can be found in the fact where he grew up. The violence is actually rooted in his childhood. Growing up in black ghetto in poor conditions, being abandoned by his father at the age of 5, being a member of a gang and doing a pretty good amount of fighting has its impact on a child’s psyche. Let us recollect what he wrote in his autobiography in 1970s. “The ghetto makes you want to hide your real identity – from cops, from teachers, and even from yourself. And it forces to build up false images”.

I also think we need to consider the nature of his relationship with Nicole because to understand everything you need to know what happened between them during the 17-year period that they were together off and on, because when you look at that, you see a motive for killing. I'm sure the Defence is going to get up here at some point and say that domestic violence evidence is irrelevant, and they may say to you that just because this Defendant had some marital discord or violence in his marriage to Nicole Brown, that it doesn't mean anything. Well, this isn't a "Just because" issue. This is a "Because" issue. It is because he hit her in the past and because he slapped her and threw her out of the house and kicked her and punched her and grabbed her around the neck, it's because he did these things to her in the past that you ought to know about it and consider it, and it's because he used a baseball bat to break the windshield of her Mercedes back in 1985 and it's because he kicked her door down in 1993. You remember the 911 call. It's because of a letter he wrote to Nicole talking about the IRS. It's because of all those things and because all of these things alongside the physical evidence at the scene, the bloody shoeprints in his size, the blood drops at Bundy, the blood on his sock, the blood trail at Rockingham, it's because when you look at all of that, it all points to him. This Defendant was jealous and he was out of control and he was consumed with passion for Nicole. He has already beaten her. He has already beaten up her car. And he does some other things. And he became enraged back then. He picked Nicole up, he threw her against the wall, and he threw her out of the house. He threw Denise out of the house and he threw all the clothes downstairs and out of the house too. Remember that testimony? This is the private side of him. This is the other side. He is out of control. And he cannot handle it. Violence is part of his life, part of his double life. He delayed the divorce because of the fear of his commercial appeal. Although the Defendant was a person who went out of his way to please everyone, he was a tyrant at home. No matter how hard Nicole tried to be perfect, she was never perfect enough for him. His ex-wife was under constant pressure. Nicole resistance provoked the Defendant to be still more aggressive. The motivation that OJ Simpson offered was that he was OJ Simpson and she still was his wife. He didn’t believe in equality in the relationship. Nicole didn’t press charges against him since she was sure nobody would believe her. She covered him up because she believed that was the case of the media picking on celebrity. Nicole tried to solve the problem herself. She went to a psychologist and did as she was told. The Defendant finally had to admit to a mutual wrestling type altercation and pleaded guilty to a misdemeanour count of spousal battery, for which he was penalized with a wrist-slap fine and a brief stint of community service. When Nicole had finally left him he would still go after her and would not let Nicole build a new life. Jurors, think about thousands of women who face the same situation. After the Defendant is found guilty, think about how many innocent lives you can actually save by this precedent. Do it not only in the name of the humiliated victim Nicole, but also in the name of justice.
