ALBANIA - NATIONAL REGULATIONS AND REQUIREMENTS

PASSPORT & VISA

A person arriving in Albania must produce valid passport or some other acceptable document satisfactorily establishing identity and nationality or citizenship, endorsed when necessary with a current Albania visa or entry clearance. In most cases visas can be issued at a border point.

Crew member licenses are acceptable.

NOTE: Additional requirements may exist. Please contact the appropriate authority to confirm information.

HEALTH

Certificates of vaccination against cholera, yellow fever and smallpox are required when arriving from infected areas.

AIRCRAFT ENTRY REQUIREMENTS

SCHEDULED FLIGHTS

International scheduled flights to/from Albania can be carried out in accordance with the Air Transport Agreement concluded between the Republic of Albania and the State of origin of airline concerned.

The authorization for the approval of scheduled service to/from Albania rests with Civil Aviation Authority (CAA) of Albania.

If not otherwise specified in the Air Transport Agreement, the time tables shall be submitted for approval to the address given below at least 30 days before the beginning of each IATA time table season. Any later modification shall be notified at least 3 working days prior to its introduction - unless a negative reply is received 24 hours prior to the flight, permission is deemed to be granted.

Applications for such permits shall be submitted in written form by mail to the Ministry of Public Works and Transportation (see GENERAL).

Operators of aircraft wishing to apply for the permission to operate scheduled service to/from Albania must provide the following information:

a.Schedule, including start date, of the proposed service;

b.Type(s) of aircraft to be used;

c.Tariffs for passenger services.

Documentary requirements for clearance of aircraft

It is necessary that the following aircraft documents be submitted by airline operators for clearance on entry and departure of their aircraft to and from Albania:

Air Operator’s Certificate and/or an Operating Licence;

Certificate of Airworthiness;

Certificate of Insurance;

Aviation Liability Insurance for passengers and third party risk. For cargo flights, certificate of third party liability;

Certificate of approval of aircraft radio installation;

Dangerous Goods Confirmation;

Statements about Aerodrome Minima;

Noise Certificate.

Leased aircraft

The above documents are also required in regard to any foreign registered aircraft leased from another aircraft which the applicant aircraft proposes to use to Albania and additionally the following information:

confirmation that the lease has been approved by the lessee’s aeronautical authorities;

confirmation of which airline’s operations and flight manuals will be used;

contact details of the lessor airline (name, address, telephone, fax).

Overflights

Prior permission is not required for scheduled flights by aircraft registered in countries that are parties to the International Air Services Transit Agreement (IASTA) or where the relevant Albania bilateral air services agreement allows overflying Albania.

Prior permission is, however, required for such flights by aircraft registered in countries that are not party to IASTA or where the relevant bilateral Air Services Agreement does not provide for either first and second freedom rights.

National Air Traffic Agency (NATA) S.A. is the approving authority for civilian scheduled flights overflying Albanian airspace.

Applications for permission shall be submitted to the Ministry of Public Works and Transportation (see GENERAL) on or before the times stipulated below:

3 working days in advance for single flights (up to four flights within two months);

20 working days in advance for series of flights (more than four flights within two months).

Operators of aircraft wishing to apply for the permission to operate charter service to/from Albania are reminded that their applications must give the following information for each flight:

name and address of operator including number of AOC;

type and call sign of aircraft, nationality and registration marks;

date and estimated time of arrival at, and departure from Albania;

aerodrome of departure and estimated time of departure;

aerodrome of arrival and estimated time of arrival;

route of flight, estimated time over entry/exit points of Tirana FIR;

purpose of flight and number of passengers and/or nature and amount of cargo; and

name, address and business of charterer, if any.

Documentary requirements for clearance of aircraft

Inclusive Tour Charter Flights

Operators of aircraft registered in a Chicago Contracting State, wishing to apply to the CAA of Albania for the permission to operate inclusive tour charter service to / from Albania, are reminded that their applications must give the following information for each series of flights:

name and address of operator;

type and call sign of aircraft, nationality and registration marks and capacity to be provided during the whole period;

date(s) and estimated time(s) of arrival at and departure from Albania;

itinerary of the aircraft;

name and address of the travel agency or tour organizer;

details of the conditions under which the inclusive tour is organized

minimum price payable by a passenger for the inclusive tour;

complete routing;

duration of inclusive tour (including stay at hotel).

In accordance with the recommendations of ECAC, CAA requires application for seasonal inclusive tour flights to be made by the following dates:

a.for flights between 1 April and 31 October, by 15 January;

b.for flights between 1 November and 31 March, by 1 September.

Permits will only authorize the carriage of passengers paying an inclusive charge for air transport, surface transport, hotel accommodation booked by the tour organizer named in the application for it. It is therefore important that any travel agent associated with the charterer of the aircraft should be named in the application.

Aerial Photography and Aerial Survey

Operators of aircraft registered in any foreign country wishing to engage in aerial photography or aerial survey flights in Albania, are required to obtain a permit from the CAA. For this purpose they must submit their applications to CAA as Non-scheduled Flights at least 20 working days in advance of the proposed operation giving the following information:

name and address of operator;

type and nationality and registration mark of aircraft;

protocol number and date of the authorization for aerial work in Albania issued by the Ministry of Defence;

names of crew and photographers and their employers (for aerial survey and photography);

complete details of proposed operations, including data, location, height to be flown, etc.;

graphic presentation of the flying area concerned.

PRIVATE FLIGHTS

Prior permission is not required for private flights of foreign civil aircraft registered in States which are parties to the Chicago Convention for overflying Albanian territory. However, the flight plan for such a flight shall be submitted to ATS Authority of Albania at least one hour prior to the flight or at least two hours prior to entering Albanian airspace.

Permissions for such flights by aircraft registered in States not parties to the Chicago Convention should be sought in accordance with the procedure as for non-scheduled commercial flights.

Prior permission is required for private flights of foreign civil aircraft to operate into or from Albanian territory. Permissions for such flights should be sought in accordance with the procedure as for non-scheduled commercial flights.

Pilots of private flights, have the obligation in respect of passport-control requirements to present their passengers on arrival and departure to the Immigration Officer or to the Customs Office.

Sports and tourist aircraft may fly along routes and use airports which are not authorised for international use, on condition that the first landing and last take-off before leaving Albanian territory is carried out from an international airport. The list of persons on board shall be attached to the flight plan.

STATE AIRCRAFT FLIGHTS

Prior permission is required for foreign state owned aircraft to operate into, from or over the territory of the Republic of Albania.

Foreign military flights shall be approved by the Ministry of Defence after coordination with the CAA of Albania.

Operational Air Traffic (OAT) military flights shall be approved by the Ministry of Defence.

Nothing in the above mentioned procedures will be applied necessarily to flights in the following categories:

aircraft in emergency condition;

urgent medical flights;

humanitarian flights;

search and rescue flights.

The above mentioned flights will be accepted subject prior notification by submission of flight plan. Flight plan shall be submitted to the ATS authority at least 1 hour prior to flight, except for emergency flights.

DANGEROUS GOODS FLIGHTS

Albanian Law prohibits the carriage of dangerous goods unless carried with the written permission of the CAA. No flight on which dangerous goods are to be carried out may be ordered unless prior permission for their carriage has been obtained.

Application must be made at least 10 days before the proposed day of the flight and should include full details of the following: United Nations number, hazard class or division, net explosive content (for explosives), full packing details, weight, air waybill number, the name and address of both consignor and consignee; the destination, the airport of arrival and departure and the date of the flight and flight number.

The above is the minimum information that is required. On occasions further information may be required. Applications and enquires for such permission should be made in writing and addressed to the Ministry of Public Works and Transportation (see GENERAL).

SPECIAL NOTICES

When a flight has been approved as required by the CAA a written permission will be granted to the operator of the aircraft.

ALBANIA - NATIONAL REGULATIONS AND REQUIREMENTS

The airport concerned will be notified by the CAA when permission has been granted. For passenger flights Customs and Excise will be notified for the purpose of Passenger Duty. Operators are responsible for making their own arrangements with the airport concerned for the reception and handling and should quote the CAA permission number when making these arrangements. Any changes in:

a.the date of operation of the flight into or from Albania;

b.the nationality or type of the aircraft to be used;

c.the route of flight; or

d.the charterer or the nature and weight of goods to be taken on board or discharged from the aircraft in Albania

must be notified by the operator to the CAA and a variation of permission obtained before the flight may be operated into or from Albania. Failure to so notify the CAA may result in the permit for the flight to be invalid. Any changes to the times of arrival at or departure from Albania must be notified to the CAA and may require a new application to be made.

Issued permission is valid for 24 hours, starting from the estimated time of entry into Albanian airspace or from estimated time of departure.

VISA

Required, except from aliens of States having signed reciprocal visa abolition agreements with Algeria. Visas for visitors are valid for one or more entries during a period of 3 months starting from the first utilization. In general, a re-entry visa is required from resident aliens.

NOTE: Additional requirements may exist. Please contact the appropriate authority to confirm information.

c.to demand that aircraft carry out their flights according to authorized itineraries or to direct them to an alternate aerodrome;

d.to demand that all aircraft overflying Algerian territory land at a designated aerodrome.

AIRCRAFT ENTRY REQUIREMENTS

SCHEDULED FLIGHTS

Scheduled operations are governed by international or bilateral air agreements or by special authorization.

NON-SCHEDULED FLIGHTS

Prior approval is required for landings of all commercial flights. Requests for approval shall be submitted at least 15 days before the first flight to:

STATE AIRCRAFT FLIGHTS

The request for authorization shall be submitted, on the prescribed form, 15 days in advance through diplomatic channels. The time allowed may be reduced to 2 working days if the flight is to be carried out for humanitarian reasons.

AIRPORT(S) OF ENTRY

Every foreign aircraft entering Algerian territory has to make its first landing at and final departure from one of the following airports: Adrar (Cheikh Sidi Mohamed Belkebir), Algiers (Houari Boumediene), Annaba (Rabah Bitat), Constantine (Mohamed Boudiaf), Ghardaia (Noumerat-Moufdi Zakaria), Hassi Messaoud (Oued Irara-Krim Belkacem), Oran (Es Senia), Tamanrasset (Aguenar-Hadj Bey Akhamok), Tebessa (Cheikh Larbi Tebessi), Tlemcen (Zenata-Messali El Hadj), Zarzaitine (In Amenas).

SPECIAL NOTICES

Permission for technical landings is valid up to 72 hours after planned date of flight.

Aircraft neither registered in an ICAO State nor in a country having interstate air agreements with Algeria have to adhere to State Aircraft regulations.

The Algerian authorities reserve the following rights:

a.to refuse authorizations given for the execution of flights in Algerian territory;

b.to prohibit overflying of certain zones;

Entry from memberstates of the European Union into the territory of Austria/exit from the territory of Austria into a memberstate of the European Union is permitted to and from all Austrian airfields.

Under consideration of the regulations concerning customs - and immigration entry from non-member- states of the European Union into the territory of Austria/exit from the territory of Austria into non-member- states of the European Union is permitted to and from the following airfields:

Dobersberg, Feldkirchen-Ossiacher See, Fer- lach-Glainach, Freistadt, Friesach-Hirt, Furstenfeld, Gmunden, Goldeck Talstation, Hofkirchen, Hohenems-Dornbirn, Hubschrauberflugplatz Glock-Ferlach, Kapfenberg, Krems-Langenlois, Kuf- stein-Langkampfen, Lanzen-Turnau, Leoben-Tim- mersdorf, Lienz-Nikolsdorf, Mariazell, Mauterndorf, Mayerhofen, Niederoblarn, Notsch im Gailtal, Pinkafeld, Pochlarn-Worth, Punitz-Gussing, Reutte-Hofen, Ried-Kirchheim, St. Andra im Lavanttal, St. Donat-Mairist, St. Georgen am Ybbsfeld, St. Johann/Tirol, Scharnstein, Scharding-Suben, Seitenstetten, Spitzerberg, Stockerau, Trieben, Voltendorf, Voslau, Weiz-Unterfladnitz, Wels, Wiener Neustadt Ost, Wolfsberg, Zell am See, Hubschrauberflugplatz Zwatzhof.

When entering/departing from the territory of Austria to/from all Austrian airfields, the pilot in command has to report at least one hour before entering the Austrian territory and one hour before departure respectively, the following details to the aerodrome operator, for immigration clearance (if necessary customs), as well as for information of the responsible ARO:

registration mark and type of aircraft,

the immediately used aerodrome before entering the territory of Austria and the aerodrome of intended landing immediately to be used after leaving the territory of Austria respectively,

the estimated time of arrival and the estimated time of departure respectively,

name and nationality of the pilot in command and the passengers.

This report of the pilot in command is not necessary when the entering/departing takes place to/from following states: Spain, Portugal, France, Belgium, Netherlands, Luxembourg, Germany, Austria, Italy, Greece, Denmark, Sweden, Finland, Iceland, Norway.

For entry and departure to and from airfields on Austrian territory which are not listed above, an exceptional permission is required for flights from/to non-memberstates of the European Union. These permissions are to be obtained from Austro Control GmbH/Aviation agency (see GENERAL).

For entry and departure to and from military aerodromes and outside an aerodrome on Austrian territory is an exceptional permission required. These permissions are to be obtained from Austro Control GmbH/Aviation agency (see GENERAL).

SCHEDULE AND AIRPORT COORDINATION

Schedule coordination and airport coordination at Austrian airports is subject to the following regulations:

the airports Graz, Innsbruck, Klagenfurt, Linz and Salzburg are facilitated airports. Vienna airport is a coordinated airport.

NOTE: General Aviation VFR-Flights are excepted from the airport coordination. Nevertheless in case of need, a PPR-regulation can be published by NOTAM at any time. The ICAO flight plan is mandatory in any case.

Innsbruck airport is a facilitated airport, except on SAT and SUN within the winter flight plan period, on which Innsbruck airport is a coordinated airport.

NOTE: General Aviation VFR-Flights are excepted from the airport coordination. Nevertheless in case of need, a PPR-regulation can be published by NOTAM at any time. The ICAO flight plan is mandatory in any case.

SCA-Schedule Coordination Austria GmbH as the designated schedule coordinator for all airports in Austria has to be notified in accordance with the deadlines set by IATA and defined in the IATA World Wide Scheduling Guidelines on all arrival and departure times (in UTC) of all scheduled and programmed charter flights as well as flights of Generaland Business Aviation on airports in Austria.

the notification of the planned arrival and departure times is required in written form per SITA, Fax, internet or e-mail.

where notification of the planned flight is submitted after the respective deadlines such flights can only be confirmed subject to availability.

the procedures above have no effect on application requirements for authorization of scheduled and non-scheduled flights by the aviation authorities. The filing periods for the application shall be strictly observed.

applications shall be submitted according to the national law to Austro Control GmbH or to the Federal Ministry for Transport, Innovation and Technology respectively.

for Vienna Airport a confirmed slot by the SCA is required.

for Innsbruck airport a confirmed slot by the SCA is required on SAT and SUN during the winter season.

SPECIAL NOTICES

Flights arriving from any country outside the Schengen Area shall use the official border crossing points when landing in Belgium. Likewise, flight departing to any country outside the Schengen Area shall take-off only from the official border crossing points. The official border crossing points are EBAW, EBBR, EBCI, EBKT, EBLG and EBOS.

When traveling by air in Belgium, entering or leaving the Schengen Area from any other aerodrome than the official border crossing points mentioned above, is illegal.

SCHEDULE AND AIRPORT COORDINATION

EBBR is a coordinated airport. Unless exempted, take-off or landing of an IFR flight without an appropriate allocated slot is prohibited and punishable. No slots will be allocated for take-off during following periods:

SAT 0000 to SAT 0500

SAT 2300 to SUN 0500

SUN 2300 to MON 0500

For every take-off and landing of a scheduled or charter flight, a slot shall be requested from the coordinator. For every other IFR flight, a slot shall be requested from or reported to the airport coordinator:

Slot applications shall normally be submitted via SITA or e-mail, whereby the procedures and formats of the IATA Standard Schedule Information Manual (SSIM, chapter 6), must be used. In exceptional cases, applications may be submitted by fax or telephone. If it is not possible to adhere to SSIM, an adjusted SSIM format or a specially developed form should be used. In any case, the application should at least include following data:

date of operation;

aircraft identification;

type of aircraft;

aerodrome of departure;

aerodrome of destination;

take-off time (STD) and/or scheduled on-block time (STA).

Short time requests shall be submitted with at least 2 hours prior notice to:

Following flights are exempted from coordination, but should be reported to the airport coordinator as far in advance as possible:

flights carrying members of the Belgian Royal Family, the Belgian governments or foreign royal families, foreign heads of state or leaders of governments, the President or commissioners of the European Commission when they are on official mission;

military missions.

Following flights are exempted from coordination, but should be reported to the airport coordinator as soon as possible after the operation:

ILS calibration flights when urgently needed for operational reasons;

missions in case of disaster or medical urgency;

police emergency flights;

SAR flights;

landing (and subsequent departures) in case of operational diversion.
