CONTRACT №2

7. Санкции

7.1.В случае неисполнения или ненадлежащего исполнения Продавцом своих обязательств по контракту Покупатель имеет право предъявить Продавцу претензии, которые должны быть рассмотрены Продавцом по существу в срок, не превышающий 21 день с даты получения претензии Продавцом.

7.2.За каждый день просрочки с ответом на претензию или задержки в переводе признанной суммы по претензии Продавец обязан уплатить штраф в размере 3% от суммы претензии, однако, не более суммы претензии.

7.3.Штраф будет удерживаться со счетов Продавца при оплате их Покупателем. В случае, если Покупатель по какой-либо причине не удержит штраф при оплате счёта Продавца, последний обязан оплатить сумму штрафа по первому требованию Покупателя.

7.3.В случае если опоздание в поставке превысит 4 месяца, Покупатель имеет право отказаться от контракта или его части.

7.4.За неизвещение или несвоевременное извещение о произведённой отгрузке оборудования Продавец уплачивает Покупателю штраф в размере 0,1% от стоимости отгруженного оборудования.

7. Санкции и рекламации

7.1.Претензии по недостаче или повреждению товара, возникших во время транспортировки, предъявляются Покупателем перевозчику или страховщику.

7.2.Продавец отвечает за выплату компенсаций убытков и за невыполнение обязанностей по контракту следующим образом:

За задержку в поставке товара согласованные компенсационные выплаты осуществляются за каждую неделю просрочки при представлении необходимых документов. Сумма выплаты составляет ….;

За задержку в поставке 95% товара позднее … месяцев после вступления контракта в силу за каждую неделю просрочки сумма составляет…….. от контрактной цены.

7.3.Величина штрафа не подлежит изменению в арбитражном порядке. Уплата штрафа и (или) неустойки не освобождает Продавца от обязательств по выполнению контракта.

7.4.Претензия об уплате штрафа должна быть заявлена в течение 3 месяцев. При этом отсчет срока начинается со дня выполнения обязательств по контракту или со дня, когда штраф по данному основанию достиг максимального размера, если обязательство не было выполнено до этого дня.
