4 Organization of the rights of a labour safety on manufacture

4.1 Owner is obliged to create on each workplace and in subitems of a working condition which meet the requirements of normative materials on a labour safety. It should provide functioning of a control system of a labour safety, т.е.:

o To create corresponding services for the decision of questions of a labour safety.

o To provide elimination of the reasons of accidents and occupational diseases.

o To organize certification of workplaces.

o To develop and approve position, instructions and other normative documents on a labour safety for the enterprise.

o To carry out the constant control over observance working norms and rules of a labour safety.

o To organize propagation of safe methods of work.

At occurrence at the enterprise of extreme situations and unhappy cases, the owner is obliged to undertake urgent steps on granting the help by the victim with attraction of rescue formations.

4.2 Working it is obliged to know and carry out

o Requirements of normative documents on a labour safety to use means of complex protection and means of an individual defence .

o To observe a rule of the internal labour schedule and position of the collective agreement.

o To pass corresponding training and the established physical examinations.

o To cooperate with the owner in questions of the organization and support of safe and harmless working conditions.

4.3 About physical examinations

The owner is obliged to organize carrying out of the previous and periodic physical examinations of the workers borrowed on tough jobs, works with harmful and dangerous conditions, and also obligatory annual physical examination of the person, in the age of up to 21 years.

Extraordinary physical examinations can be organized under the request working or at the initiative of the owner. For the period of physical examination and training on a labour safety for working is kept average earnings.

The owner has the right to involve in a disciplinary responsibility and to discharge of work without preservation of wages of workers which evade from training on a labour safety or obligatory physical examinations.

4.4 About training on a labour safety

The state committee on a labour safety has accepted typical position about instructing and training on a labour safety. Training on a labour safety is carried out on the following directions:

o Compulsory education to bases of a labour safety in all educational institutions of an education system.

o Special preparation and improvements of professional skill of experts on a labour safety.

o Instructing on a labour safety, at acceptance for work and periodically during work.

o Theoretical preparation with following delivery of test of officials of the enterprise or establishment.

o The Previous special training and regular annual examination on a labour safety on robots with the raised danger.

The admission to work of persons that have not passed examination on a labour safety is forbidden. In case of the unsatisfactory knowledge, working should be trained and corresponding examination. In case of repeated revealing unsatisfactory knowledge the worker is discharged of a post on discrepancy.

Instructing behind character and from time to time carrying out are subdivided on:

o Introductory

o Primary

o Repeated

o Off-schedule

o Target

Introductory instructing is spent:

o With all workers who are accepted for constant or time work, irrespective of formation, the experience of work and a post;

o Workers of other organizations who are accepted at the enterprises which are in business trip and accept direct participation in production;

o Students at passage of an industrial practice, and also in case of excursion on territory of the enterprise;

The program of introductory instructing includes following questions:

o The general data on the enterprise

o Rules of behaviour in territory

o Substantive provisions of documents on a labour safety

o The characteristic of danger of harmful factors at the enterprise

o Requirements on safety of work and sanitary

o Rules of granting of first aid

Carrying out as it, and other instructing is fixed in special magazine with signatures of persons that spent and passed instructing.

Primary instructing is spent to the beginning of work directly on a workplace to workers who again accepted on the enterprise or are translated in another shop, and also workers who will perform new, unusual work for them. It is spent by the chief, its assistant, the mechanic of shop. Primary instructing comprises the general data on manufacture, the list of dangerous and harmful factors, data on safe methods of carrying out of work, on the order of preparation for work, about means of complex protection and means of an individual defence. After passage of instructing all working during one month pass training under direction of. Passage of training is fixed.

Repeated instructing is spent on a workplace not less often than an once to three months at robots with the raised danger and not less often than once in half a year on other robots.

Off-schedule and extraordinary instructing are spent on a workplace in a cabinet of a labour safety in following cases:

o At change of normative documents on a labour safety

o At change of technological processes, raw material, a material

o At infringement by workers of rules on a labour safety

o On demand of workers of the state supervision

o At breaks in work more than 30 calendar days for works with the raised danger and more than 60 days for other works.

Target instructing is spent at performance of single works, untied with performance of industrial duties, untied with work, at work on liquidation of failure, before work before which the admission is made out.

4.5 Protection service of work at the enterprise

At each enterprise the owner is obliged to create a protection service of work. At quantity 50 person working less these functions can carry out persons in combination with corresponding preparation. If 50 person special service is more is created. Protection services of work are equated to the basic industrial services and can be liquidated only at liquidation of the enterprise.

Employees of service to a labour safety have the right:

o To give out to heads of subitems of instructions (obligatory for performance) on elimination of the lacks connected with a labour safety

o To receive from the head of subitem necessary data and the documentation

o To demand discharge from work of persons which evade from the established instructing, examination on a labour safety, physical examinations, persons that are not carried out with specifications on a labour safety

o To stop work of workplaces or sites of the equipment which threaten health working

o To direct to administration of representation on the persons guilty of infringement of rules of a labour safety

o On a labour safety heads of the enterprises can cancel the Order of services only
