19. Organizational and legal issues concerning Ukraine's accession to the European Union.

In order to implement the strategic course of Ukraine towards integration the European Union, ensuring full integration of Ukraine

in European political, economic and legal space and creating conditions for Ukraine's membership in the European

Union, Ukraine has made a strategy. This strategy defines the main directions of cooperation of Ukraine

the European Union.

The national interests of Ukraine require identification of Ukraine as an influential European country, a full EU member. In

result expected in the coming years the EU enlargement – accession the EU of Poland and Hungary - Ukraine will border the EU, which will create fundamentally new geopolitical situation. In this regard, is clear and comprehensive definition of the foreign Strategy for Ukraine's integration into European political (in including in foreign and security policy) information, economic and legal space. In this context, the most important factor in Ukraine gained associate membership in the European Union has forced the introduction of market reforms, which requires:

• strengthening of public finances;

• administrative reform;

• reducing barriers to private economic activity;

• acceleration of privatization;

• restructuring of key sectors;

• improve the conditions of competition;

• improving the social security system, which provides primarily for pension reform;

• further trade liberalization.

Associated membership of Ukraine in the European Union should consider another important step towards bringing Ukraine closer to the performance criteria for full membership of Ukraine, as defined in the Declaration adopted by the European Council summit in Copenhagen in June 1993.

Membership requires:

• that the candidate country has achieved institutional stability and guarantee democracy, rule of law, human rights and respect for the Protection of Minorities,

• the existence of a functioning market economy and ability to cope with competitive pressure and market forces within the Union;

• the ability to accept the obligations of membership including adherence to the aims of political, economic and monetary union;

• Union's capacity to accept new members while maintaining at the same time promoting the process of European integration (which is an important factor in ensuring the overall interests of both the Union and candidate countries)

To date, the foundation granting Ukraine associate membership in the EU should consider a full-scale implementation of the Partnership and Cooperation between Ukraine and the European Union (PCA).

It should be noted that under trade liberalization in general administrative intervention aimed at creating barriers to free trade. Examples of such barriers are:

• Indicative export prices;

• excise tax regime, which violates the terms of the national tax treatment for imported goods;

• availability of technical barriers, the practice of which is not always the same as existing within the EU;

• mode of import licenses;

• export duties;

• high tariff protection.
