Step 1. Study the following text about different financial instruments.
В отличие от континентального права в праве Англии и США чек признается оборотным документом и квалифицируется как разновидность переводного векселя, выставленного на банкира. Однако, если переводной вексель может быть выставлен практически на любое лицо и выступает прежде всего в качестве инструмента кредита, то чеки выполняют в основном функцию средства платежа и всегда выставляются только на банк, в котором у чекодателя имеются деньги на счете. Чеками можно пользоваться для осуществления платежей со счета одного лица и оплаты переводом на счет в банке другого лица.
В чековых отношениях, так же как и в отношениях в связи с выдачей переводного векселя, участвуют три лица: чекодатель, банк-плательщик и ремитент (чекодержатель). Он содержит приказ чекодателя плательщику-банкиру заплатить ремитенту определенную сумму по предъявлении чека к оплате. Банк выплачивает деньги из средств, внесенных чекодателем как клиентом банка. Чекодатель является кредитором, перед которым два лица имеют обязательства: банк-плательщик, а в случае неоплаты чека — чекодатель. Выставляя чек на счет без покрытия, что по законодательству ряда стран представляет уголовно наказуемое деяние, чекодатель отвечает за платеж.
Чек, как и вексель, строго формальный письменный документ. Он может быть заполнен любым способом (от руки, на машинке), однако подпись чекодателя обязательно должна быть собственноручной, образец этой подписи находится у банка-плательщика.
Различаются чеки именные, ордерные и предъявительские. Именной чек выписывается на имя определенного лица без права дальнейшей передачи по индоссаменту. Ордерный чек выписывается по приказу определенного лица и передается посредством именной или банковой передаточной надписи, совершаемой на обороте документа. Предъявительский чек выставляется на предъявителя либо без указания получателя, и право на него передается простым вручением.
Для защиты чеков на случай их утраты, хищения, подделки банками были выработаны так называемые кроссированные чеки, т. е. чеки, на лицевой стороне которых проведены две линии, перечеркивающие чек. Кроссирование называется общим, когда между линиями нет никаких отметок или вписаны слова «банкир», «компания». Такой чек может быть оплачен любому банку или клиентам банка-плательщика, имеющим у него счета. При специальном кроссировании вписывается наименование конкретного банка, и чек оплачивается только указанному банку.
