Vehicle Driving

    1. Unless otherwise specially provided in Part 4 on use of roadways arranged as bus lanes, use of roadways shall be in accordance with the provisions under this part.

    2. In using roadways a driver shall be careful not to hit or come into contact with the pedestrians no matter at what part of the road and shall display warning signal for the pedestrians to become aware whenever necessary. The driver shall be especially carefully in controlling his vehicle when children, aged persons or invalids are using the way.

    3. In driving a vehicle the driver shall keep to the left of the roadway and must not run beyond the middle of the roadway, except in the following cases in which a vehicle may travel on the right-hand side or travel along beyond the middle of the roadway:

  1. There is obstruction or traffic is closed on the left hand side of the road way.

  2. The roadway is prescribed by the traffic officer as one-way roadway.

  3. The roadway is less width than six meters.

    1. In using a roadway with two and more traffic lanes in the same direction or with a bus lane arranged on the outermost left-hand side traffic lane, a driver shall drive his vehicle in the outermost left lane or close to the bus lane except in the following cases in which a vehicle may travel on the right-hand side of the roadway:

  1. There is obstruction or traffic is closed on the left-hand side of the roadway.

  2. The roadway is prescribed by the traffic officer as one-way roadway.

  3. It is necessary to enter the correct lane upon approaching a junction.

  4. When about to overtake another vehicle

  5. When the driving his vehicle with faster than vehicle running on left-hand lane.

    1. The driver of a truck, passenger vehicle, motorcycle at low speed or traveling at lower speed than those of other vehicles moving in the same direction shall keep as close to the roadway curb as possible. If such roadway is divided into two or more traffic lanes in the same direction or has a bus lane specially arranged on the left-hand side, the driver shall drive the vehicle in the outermost left-hand side lane or close to the bus lane, as the case may be.

    2. The driver who is turning must allow other vehicles to pass or overtake, change traffic lane, reduce the vehicle speed, park or stop the vehicle and he shall display hand or arm signal according to Section 37 or light signal according to Section 38 or other signal according to rules of the traffic officer.

If the condition of the vehicle, conveyance or the visibility does not permit hand and arm signals in pursuance of paragraph one to be visible to the drivers of the vehicles that are passing or following behind, the driver shall display light signals. A driver shall display hand and arm signal, light signal or other signal in pursuance of paragraph one at not less distance than sixty meters before turning the vehicle, changing traffic lane, parking or stopping the vehicle.

    1. In displaying hand and arm signals, a driver shall perform as follows:

  1. To reduce vehicle speed, he shall stretch his right arm straight out of the vehicle at shoulder level and then move it up and down several times.

  2. To stop a vehicle, he shall stretch his right arm straight out of the vehicle at shoulder level and raise the lower part at right angle to the upper part with upright open palm.

  3. To let another vehicle pass or overtake, he shall stretch his right arm straight out of the vehicle at shoulder level and move the hand forward several times.

  4. To turn the vehicle to the right or move onto the traffic lane on the right, he shall stretch his right arm straight out of the vehicle at shoulder level.

  5. To turn the vehicle to the left or move onto the traffic lane on the left. He shall stretch his right arm straight out of the vehicle at shoulder level and then bend the wrist up and wave to the left several times. For the benefit of this Section in the case that the automobile has its steering wheel at the left-hand side, the driver shall use light signals instead of hand and arm signals.

    1. The driver of an automobile or motor-cycle shall display light signals as follows:

  1. To stop the vehicle, the driver shall display red light signals at the back of the vehicle.

  2. To turn the vehicle or change traffic lane, the driver shall display amber light for turning or display the blinking white signal or amber light signal at the front or side of the vehicle and the blinking red or amber light signal at the back and to the left of the vehicle.

  3. To let another vehicle to overtake, the driver shall display amber light signal for turning or blinking red or amber light signal at the back and to the left of the vehicle.

    1. Upon driving vehicles passing one another in opposite directions, each driver shall keep his vehicle close to the left-hand side of the roadway judging by the middle line of the roadway. But if the roadway is divided into traffic lanes, it shall be based on the dividing line. Upon passing one another in opposite directions in a narrow roadway, the driver of each of the vehicles shall reduce the speed of his vehicle to ensure safe passing. In a narrow roadway where moving vehicles cannot pass each other safely in opposite directions the driver of the larger vehicle shall stop his vehicle close to the curb on the left-hand side of the roadway to let the smaller vehicle pass. In a roadway in which there is an obstruction ahead, the driver of a vehicle shall reduce the speed of vehicle or stop his vehicle to let the vehicle coming in the opposite direction pass.

    2. The driver of a vehicle shall keep his vehicle in at safe distance from another vehicle in front of allow a safe stopping in case he is required to stop his vehicle. The driver who drives his vehicle up a bridge or a slope way shall be careful not to let his vehicle glide backwards and crash into another vehicle.

    3. The driver shall drive his vehicle in the prescribed direction in a roadway indicate by a traffic sign as one-way roadway.

    4. The driver shall keep his vehicle close to the left-hand side of a roadway divided into two ways, one for the vehicles going up and the other for the vehicles coming down, with a dividing space in the middle or with a traffic sign indicating that the roadway being divided into two ways.

    5. No driver of a vehicle shall drive the vehicle:

  1. while being incompetent to drive;

  2. while intoxicated by liquor or other alcoholic drinks;

  3. in a manner that obstructs the traffic;

  4. with carelessness or recklessness which may cause danger to persons or property;

  5. in a manner not normally practiced in driving a vehicle or while unable to see the way in front or at the back and one either side or both sides clearly enough for safety.

  6. beyond or on the line dividing traffic lanes, except upon changing lane, turning or turning around the vehicle;

  7. on a footpath without sufficient cause, except a baby-carriage or a wheel-chair for sick or crippled persons;

  8. Without thinking about the safety or suffering of other persons.

Section 43 bis. A driver may not use narcotics under the law on the Narcotics or take drugs that affect the mind or the nervous system of the person in accordance with the notification of the Director General proclaimed in the Government Gazette.

The traffic officer, the inquiry official, the competent officer or the inspector shall have the power to examine the driver as the Director General provided and proclaimed in the Government Gazette that the driver taking the drug or not as in the foregoing paragraph in this section. In the examination if it appears that such driver does not take drugs he will be acquitted as soon as possible. In the case the driver refuses to be examined, the traffic officer or the inquiry official or the competent officer or the inspector shall have the power to keep him in the custody to be examined at an appropriate time. The examination in this section will be according to the rules and procedures that prescribed in the ministerial regulations.

Section 43 ter. In the case the driver violates the section 43 (1) or (2) the inspector shall have the power to stop the driver and examine him according to the section 142.

Section 43 quarter. In the case the driver violates the section 43 (1) or (2) or the section 43 bis paragraph one the inspector shall have the power to send the driver with the ‘prima face’ evidence to the inquiry officer as soon as possible but not exceeding six hours from the wrong doing.

Section 43 quinque. In the performing of duty in the section 43 bis and section 43 ter the inspector has to show the identity card that is issued to him in accordance with the laws on Land traffic.

Overtaking and Passing

    1. A driver who wishes to overtake or pass another vehicle in the roadway with no traffic lane marks shall use sound signals loud enough to let the driver who is driving the vehicle in front of his intention and, after the driver of the vehicle in front gives a responding signal pursuant to Section 37 (3) or Section 38 (3), may proceed to overtake. A driver of a vehicle shall overtake another vehicle on the right-hand side of and at suitable distance from the vehicle being overtaken and after having gone past the said vehicle for a safe distance shall steer his vehicle to and keep it on the left-hand side of the roadway.

    2. No driver of a vehicle shall overtake another vehicle on the left-hand side except in the following circumstances:

  1. The vehicle to be overtaken is making right turn or has given a signal that he is going to make a right turn;

  2. The roadway is arranged with two or more traffic lanes in the same direction. Overtaking a vehicle on the left-hand side under (1) or (2) shall be done only when there is no vehicle close behind or it is sufficiently safe to do so.

    1. No driver of a vehicle shall overtake another vehicle in the following circumstances:

  1. When he is driving his vehicle up a slope, bridge or on a curve except at a place where there is a traffic sign permitting overtaking;

  2. Within a distance of thirty meters from a pedestrian crossing, junction, circle or constructed island, or a roadway that crosses railway tracks;

  3. At the time when there is fog, rain, dust or smoke so dense that the way ahead is invisible at a distance of sixty meters;

  4. When entering critical location or safety zone.

    1. No driver of a vehicle shall drive his vehicle to overtake or pass another vehicle by, in doing so, going beyond the roadway’s middle line that is marked or where there is a traffic sign indicating a danger area or an area in which carefulness is required on the roadway. In the event of the left-hand side traffic lane is obstructed while the traffic lane on the right-hand side has sufficient space, a driver of a vehicle may avoid the obstructions by driving his vehicle beyond the roadway’s middle line prescribed by the traffic officer in so far as he does not obstruct the traffic of the vehicles moving in the opposite direction.

    2. No driver of a vehicle shall drive his vehicle to overtake or pass another vehicle by going over onto the bus lane except that there is obstruction of traffic on the roadway ahead or the driver is required to comply with the order of the traffic officer, however, for only as long as it is necessary

    3. Upon receiving a signal for overtaking from a vehicle immediate behind, the driver of a vehicle which is able to move at a low speed or is moving at a lower speed than that of other vehicles going in the same direction shall allow the vehicle to overtake and, in doing so, the driver being requested to be overtaken shall display a responding signal pursuant to Section 37 (3) or Section 38 (3) upon seeing that the roadway ahead is safe and there is no vehicle moving in the opposite direction in a close distance and shall reduce the speed of the vehicle and keep the vehicle close on the left-hand side of the roadway in order to let vehicle immediately behind overtake in safety.

Stating Off, Turning and Turning around vehicles

    1. A driver who starts off a vehicle shall, upon seeing that there is a parked vehicle or obstruction ahead, display hand and arm signals pursuant to Section 37 or light signals pursuant to Section 38 and shall proceed upon seeing that it is safe and he is not obstructing the traffic of other vehicles.

    2. In turning a vehicle, the following shall be observed:

  1. To turn left

    1. where no traffic lanes are arranged, the driver shall keep his vehicle close on the left-hand side of the roadway:

    2. where traffic lanes are arranged and there is an traffic sign directing a left turn, the driver shall enter the traffic lane for vehicles to make a left turn at not less distance than thirty meters before the turn-way;

    3. where a bus lane exists on the outermost left hand side of the roadway, the driver shall keep his vehicle close to the bus lane at not less distance than thirty meters before the turn-way and shall make a turn across the bus lane only at the area where there is a traffic sign permitting such turn.

  2. To turn right

    1. on a roadway with no traffic lane, the driver shall keep his vehicle close on the right-hand side of the middle line of the roadway at not less distance than thirty meters before the turn-way;

    2. on a roadway with two and more traffic lanes in one same direction, the driver shall keep the vehicle close to the outermost right-hand side of the roadway or in the traffic lane with a traffic sign permitting a right turn at not less distance than thirty meters before the turn-way;

    3. where a bus lane exists on the outermost right-hand side of the roadway, the driver shall keep his vehicle close to the bus lane at not less distance than thirty meters before the turn-way and shall make a turn across the bus lane only at the area where there is a traffic sign permitting such turn;

    4. where a traffic officer or competent officer is displaying traffic signs by hands and arms, the driver shall make a right turn without having to round the traffic officer or competent officer;

    5. At a junction the driver shall allow the vehicles that travel in the same roadway but in the opposite direction to pass through the junction first and, upon seeing that it is safe, may then make a right turn.

In the cases pursuant to (1) and (2) the driver shall be careful and shall stop his vehicle and let the pedestrians cross the way and the vehicles approaching a junction from other directions pass through first, except in case that there are vehicles waiting to take a left turn and a right turn at the same time which the vehicle to turn left shall give way to the vehicle to turn right to go first.

    1. In a roadway that permits vehicle traffic in both directions, no driver shall turn around his vehicle at the time when another vehicle is coming in the opposite direction or following behind at not less distance than one hundred and fifty meters. If the turning around of a vehicle in a roadway that permits vehicle traffic in both directions will obstruct the traffic, no driver shall turn around his vehicle in such roadway.

    2. No driver shall

  1. turn his vehicle or turn around his vehicle in the roadway with a sign prohibiting a right turn a left turn or a turning around of a vehicle;

  2. turn around his vehicle at a safety zone, critical area, on a bridge or within a distance of one hundred meters from a bridge foot;

  3. Turn his vehicle at a junction, unless there is a traffic sign permitting vehicles to turn around.

Stopping and Parking Vehicles

    1. A driver shall display hand and arm signals pursuant to Section 37 or light signals pursuant to Section 38 before he stops or parks his vehicle in not less distance than thirty meters and shall stops or parks only when he sees that it is safe and does not obstruct the traffic to do so. A driver shall park his vehicle on the left-hand side of the roadway and with the left side of the vehicle parallel with and close to the curb or road shoulder in a distance not exceeding twenty-five centimeters or park his vehicle in the direction or on the side of the roadway as prescribed by the traffic officer. But in case of a roadway with a bus lane on the outermost left-hand side of the roadway, no driver shall park his vehicle in the said manners during the time prescribed for the use of such bus lane.

    2. No driver shall stop his vehicle:

  1. in a traffic lane except stopping close to the curb on the left-hand side of the motorway in case of there being no bus lane;

  2. on a footpath;

  3. on a bridge or in tunnel;

  4. at a junction

  5. in an area where there is a display of a traffic sign prohibiting stopping of vehicles;

  6. at the entrance and exit of a building or roadway;

  7. in a safety zone.

  8. In the manner of traffic obstruction.

The provision in paragraph one shall not apply to a driver who has to stop his vehicle because the roadway is obstructed or the engine or equipment of the vehicle is out of order or who is complying with the traffic signal or traffic sign.

    1. In the event of a vehicle is stopped in the roadway due to the failure of the engine or equipment of the vehicle, the driver shall move such vehicle out of the roadway soonest. In case of pursuant to paragraph one, if it is necessary to park the vehicle in the roadway, the driver shall park such vehicle in a manner not to obstruct the traffic and shall display signs or signals in accordance with the characteristics and conditions prescribed in the Ministerial Regulations.

    2. Unless otherwise provided or prescribed by regulations or rules under this Act, no driver shall park his vehicle:

  1. on a footpath;

  2. on a bridge or in a tunnel;

  3. at a junction or within a distance of ten meters from a junction;

  4. at a crossing or within a distance of three meters from a crossing;

  5. in an area where there is a display of a traffic sign prohibiting parking of vehicles;

  6. within a distance of three meters from a hydrant;

  7. within a distance of ten meters from a traffic signal installation;

  8. within a distance of fifteen meters from a railway crossing;

  9. in the manner of a double crossing with other vehicle already parked;

  10. at the entrance and exit of a building or roadway or within a distance of five meters from the entrance of a roadway;

  11. in between a safety zone and the roadway curb or within a distance of ten meters from either end of a safety zone;

  12. in a critical area;

  13. within a distance of fifteen meter before and three meters beyond a bus stop;

  14. within a distance of three meters from a pillar-box;

  15. in a manner that obstructs the traffic.

    1. In parking a vehicle in a roadway the driver shall stop the engine and apply the brake. In parking a vehicle in a roadway which is steep or sloping, the driver shall set the front wheel or wheels to face the curb of the way.

    2. The traffic officer or the competent officer is empowered to order a driver to move his vehicle which is stopped in a manner in violation of a provision of this Act from obstructing the traffic. In the event of the absence of the driver or the driver being present but refusing to comply with the order of the traffic officer or competent officer pursuant to paragraph one, the traffic officer or competent officer shall have the power to have such vehicle moved. The Traffic officer or the competent officer is empowered to move vehicle, which is stopped or parked in a manner in violation of a provision of this Act, or to have tools compel the vehicles not move. To move or to have the tools to compel a vehicle, which is stopped or parked, not move pursuant to the paragraph two is not responsibility of the traffic officer or the competent officer if any damage occurred from doing pursuant the Act except that damage occurs by his intention or carelessness.

    1. In stopping or parking a vehicle in a roadway outside a municipal area, the driver shall stop or park the vehicle at a place being visible to the drivers of other vehicles within not less distance than one hundred and fifty meters.

    1. During the time when there is insufficient light for the driver of a vehicle to see clearly a vehicle parked in a roadway within not less distance than one hundred and fifty meters, the driver who parks his vehicle in the roadway or road shoulder shall have lights put on or displayed in accordance with the categories, characteristics and conditions prescribed in the Ministerial Regulations.

    2. If it appears at any part of a roadway where there is a railway crossing:

  1. a sign or signal warning of trains being displayed to indicate a train being about to pass;

  2. the presence of a barrier or the traffic officer displaying a signal to announce the passing of a train;

  3. a sound of a train or an approaching train which may be dangerous to the driving across the tracks.

The driver shall reduce the speed of vehicle and stop his vehicle at not less distance than five meters from the railway tracks and, after the train has passed and a sign or signal is displayed permitting vehicles to cross, then the driver may proceed with his vehicle.

    1. In any part of a roadway where there is a railway crossing. With or without a beware-of–the–train sign, and if the railway tracks have no beware-of–the–train sign or barrier, the driver of a car shall reduce the speed of his vehicle and stop the vehicle at not less distance than five meters from the railway tracks and upon seeing that it is safe, may then proceed with the vehicle.

    2. While the driver of a school bus stops the vehicle in roadway to pick up and deliver students, the drivers of other vehicles moving in the same direction from behind or coming from the opposite direction shall be careful and shall reduce the speed of their vehicles and shall pass such school bus only when it is safe to do so.

Use of Roadways with Traffic Lanes

    1. The drivers of buses and passenger vehicles according to the categories prescribed by the Director General shall, while picking up and delivering or conveying passengers, must drive the vehicles within the traffic lanes announced by the traffic officer as the bus lane and may drive the vehicles outside the bus lane only when such lane is obstructed or upon being required to comply with an order of the competent officer.

The categories of passenger vehicles required to be kept to a bus lane shall be prescribed by Director General and announced in the Government Gazette.

The announcement of the prescription of a traffic lane as the bus lane pursuant to paragraph one may also include the time prescribed for the use of such bus lane.

In case of necessity concerning traffic, the traffic officer shall have the power to declare the passenger vehicles of any of the categories prescribed by the Director General pursuant to paragraph two as the vehicle required to keep to the bus lane of any roadway at any part.

    1. No the driver of another vehicle except a bus or a passenger vehicle of the category prescribed by the Director General shall be driven in a bus lane except in complying with the provisions of this Act.

Prescriptions of Speeds of Vehicles

    1. A driver shall drive his vehicle at the speeds as prescribed in the Ministerial Regulations or as specified on the traffic signs installed along the way.

Maximum or minimum speed limits may also be specified on the installed traffic signs pursuant to paragraph one but shall not exceed the rates prescribed in the Ministerial Regulations.

    1. A driver who is to turn his vehicle to let another vehicle overtake or pass, to park, stop or turn around his vehicle, shall reduce the speed of the vehicle.

    2. A driver who drives his vehicle in a roadway on a hill, on a bridge, at a bridge foot, through a narrow pass, on a curve, on a slope, at a critical area or at a place where there is fog, rain, dust or smoke so dense that the way ahead is invisible within a distance of sixty meters, shall reduce the speed of the vehicle to the extent that it is safe.

    3. A driver who is approaching a junction, pedestrian crossing, vehicle stop line or circle shall reduce the speed of his vehicle.

Driving through Junctions or Circles

    1. Under the provisions of Section 21 and Section 26, the drive of a vehicle shall comply with the following directions upon arriving at a junction :

  1. if other vehicles are already present in the junction, the driver shall allow such vehicle to go through first ;

  2. upon arriving at the junction at the same time as other vehicles and there is no vehicle in the junction, the driver shall let the vehicle on his left to go through first, except where a principal roadway cuts across a secondary roadway at the junction, the vehicles in the principal roadway shall have the right to pass through first.

    1. A principal roadway is a roadway is a roadway which is announced by the traffic officer to be and installed with traffic signs indicating it a principal roadway. A roadway other than a principal roadway pursuant to paragraph one shall be regarded as a secondary roadway.

    2. If a circle is installed with traffic signals or signs, the driver of a vehicle shall comply with such traffic signals or signs. Upon arrival at a circle without the traffic signals or signs pursuant to paragraph one, the driver of a vehicle shall allow another driver who is driving a vehicle in the roadway on his right to pass first. In the event of the traffic officer deems it appropriate for the safety or convenience of the traffic, traffic signals other than those provided in paragraph one or paragraph two may be made available In such case, the driver of a vehicle shall comply with such traffic signals.

    3. A driver, who is driving a vehicle out of a private way or a roadway in a building area, before crossing or turning into the roadway that cuts across, shall stop his vehicle to let the vehicles passing or moving in the roadway through before proceeding upon it being safe.

Emergency Vehicles

    1. A driver of an emergency vehicle, while driving the vehicle to perform his duty, shall be entitled to:

  1. display a flashing light signal, siren-sound signal or other sound signal prescribed by the Director General

  2. stop or park the vehicle at a prohibited area

  3. drive the vehicle over the speed limits

  4. drive the vehicle in violation of the traffic signals or signs that demand vehicles to stop but the speed of the vehicle must be suitable reduced

  5. omit complying with the Act’s provisions or traffic rules on traffic lanes, direction of driving or turning of vehicles prescribed.

In complying with the directions pursuant to paragraph one, the driver of a vehicle shall apply proper carefulness.

    1. Upon seeing an approaching emergency vehicle with the displaying a flashing light signal or hearing its siren – sound signal or other sound signals prescribed by the Director General, a pedestrian or driver of a vehicle or driver or controller of animals shall let the emergency vehicle pass through first by acting in the following manner:

  1. a pedestrian shall stop and keep close to the way curb or step up on the way of the safety zone or the nearest road shoulder

  2. a driver shall stop or park his vehicle close to the way curb on the left-hand side. In the case there is a bus lane on the outermost left – hand side of the roadway, he shall stop or park his vehicle close to the bus lane, but shall never stop or park his vehicle in a junction

  3. a driver of animals shall control the animals to rest close to the way but never in a junction.

In complying with (2) and (3) the driver of a vehicle and the driver of animals shall accomplish the tasks as soon as possible and shall apply proper care.

Towing or Pulling Vehicles

    1. No person shall use a vehicle of any kind to tow or pull more than one other vehicle in a roadway, except with permission of the Director General.

A vehicle shall be towed or pulled by the method and signs shall be made available for the safety for the vehicle towing or pulling in accordance with the prescriptions in the Ministerial Regulations.

Accidents

    1. Any person who drives a vehicle or controls animals in a way and causes damage to other person or other person’s property, be it his fault or not, shall stop the vehicle or animals and give appropriate assistance, and immediately report the incident to the competent officer who is on duty near to scene as well as leave the information of his full name and address and the vehicle register number with the injured person.

In the event a driver of the vehicle or of animals escapes or does not report himself to the competent officer at the scene of the incident, it shall be presumed that he is the offender and the competent officer shall have the power to seize the vehicle driven by the driver who has escaped or has not reported himself as the driver until the case received the final judgment or the driver is found.

If the owner or possessor does not make his presence to the competent officer within six months from the day of the incident, it shall be regarded that the vehicle was employed in the commission of the crime or in connection with the commission of the crime and it shall become the property of the state.

Bicycles

    1. Where a way is provided for bicycles, cyclists shall ride their bicycles in such way.

    2. A cyclist who rides his bicycle in a roadway, road shoulder or way provided for bicycles shall have the bicycle completely equipped with:

  1. a hand – bell that can send out sound signals audible within not less distance than thirty meters

  2. a brake that functions well and when applied is able to bring the vehicle to a stop abruptly

  3. at least one front lamp that projects white light beam straight ahead and is able to illuminate the path clearly within not less distance than fifteen meters and shall be at a level lower than the eye of another cyclists who come in the opposite direction

  4. not less than one bicycle back lamp than one that emits red light beam straight back wards or a material that reflects red light upon a beam being thrown upon.

    1. At the time light is required to be displayed pursuant to Section 11 or Section 61, a cyclist who is riding a bicycle in a roadway, road shoulder or way provided for bicycles shall put on the front light to enable another cyclist or the pedestrians who is riding or are walking in the opposite direction to see his bicycle.

    2. A cyclist who rides a bicycle shall keep close to the curb on the left-hand side of the roadway, road shoulder or way provided for bicycles as much as possible. In case of bus lanes on the outer most left hand side of the roadway, a cyclist shall ride bicycle close to such bus lane.

    3. In roadway, road shoulder or way provided for bicycles, no cyclist shall

  1. ride his bicycle carelessly or in a dangerous manner which might cause damage to persons or property

  2. ride his bicycle without holding its hands to control

  3. ride his bicycle with more than one bicycle, except in a way provided for bicycles

  4. ride his bicycle by sitting other than the saddle which is meant for normal riding

  5. ride his bicycle to convey another person, except a tricycle for conveying persons in accordance with the conditions prescribed by the traffic officer

  6. ride his bicycle to convey or carry articles, boxes or other things in the manner that obstructs the handling of the control part of the vehicle or that might cause danger to persons or property

  7. ride his bicycle by towing or being coupled to another moving vehicle.

    1. Unless this Title provides it to be otherwise, a cyclist who rides his bicycle shall comply with Section 21, Section 22, Section 23, Section 24, Section 25, Section 26, Section 32, Section 33, Section 34, Section 36, Section 37, Section 39, Section 40, Section 41, Section 42, Section 45, Section 46, Section 47, Section 48, Section 49, Section 50, Section 51, Section 52, Section 53, Section 54, Section 55, Section 56, Section 57, Section 59, Section 60, Section 61, Section 62, Section 63, Section 64, Section 69, Section 70, Section 71, Section 72, Section 73, Section 74, Section 76<2>, Section 78, Section 125, Section 127, Section 133, mutatis mutandis.

Passenger Vehicles

    1. Owner or driver of a passenger vehicle shall not undertake to convey a corpse or a leper or a person suffering from an epidemic disease that is required to be reported according to the law on epidemic disease along with other passengers, except:

  1. in case of such passenger vehicle not being used to convey other passengers, then it may convey lepers or persons suffering from an epidemic disease that are required to be reported according to the law on epidemic diseases

  2. in case a passenger vehicle is not being used to convey other passengers, then it may convey a corpse along with the relatives or persons concerned with the corpse.

    1. Owner or driver or conductor or person who has interest in a passenger vehicle shall not solicit passengers to board the vehicle noisily or in a manner being a nuisance to the passengers or other persons, or round up or pull or hold back or force persons or things on any passenger vehicle.

    2. Owner or driver or conductor of a passenger vehicle shall not refuse to convey a passenger without a proper cause.

    3. A driver shall stop his passenger vehicle to deliver his passengers at a bus stop or at a place agreed upon, as the case may be.

    4. Driver or conductor of a passenger vehicle shall not convey passengers in a number exceeding that prescribed by law.

In counting the number of passengers, it shall be regarded that two children not older than 10 years of age are equal to one passenger.

    1. Driver of a passenger vehicle shall not

  1. drive about to seek passengers

  2. park the vehicle at the head of a row of other vehicles at a distance of more than one meter from the traffic sign

  3. park the vehicle at the end of a row of other vehicles at a distance of more than one meter from the vehicle immediately in front

    1. Driver or conductor of a passenger vehicle shall not

  1. smoke or engage in conversation during driving or collecting fares

  2. use impolite language to, speak sarcastically at insult, abuse or act in such manner to the passengers of other persons.

  3. before refilling a passenger vehicle with inflammable fuel oil with a flare-up point at 21 Celsius or lower, the driver shall stop the engine and shall have all the passengers leave the vehicle.

Taxis

    1. Driver of a taxi shall not refuse to a accept employment to convey passengers, except when such conveyance is likely to cause danger to himself or the passengers.

In the event the driver of a taxi does not wish to be employed to convey passengers, a placard shall be displayed that the taxi is not in use for passenger conveyance.

The manner of the display and the characteristics of the said placard shall be in accordance with the law on automobiles.

    1. Driver of a taxi shall not convey passengers exceeding that prescribed in the license under the law on automobiles.

In counting the number of passengers, it shall be regarded that two children not older than ten years of age are equal to one passenger.

    1. Anyone shall not

  1. solicit passengers for a taxi noisily or in a manner being a nuisance to the passengers or other persons

  2. round up, pull, hold back or force persons or their belongings to board any taxi

    1. Driver of a taxi shall not charge a fare in excess of the amount registered in the taxi meter.

The characteristics and use of a taxi meter shall be in accordance with the prescriptions in the Ministerial Regulations.

    1. The passengers shall pay a fare according to the amount registered in the taxi meter.

    2. A royal decree shall be issued to prescribe localities and taxis of every type or certain types to which the provisions of Section 96 and Section 97 shall apply with conditions.

In a locality not governed by the royal decree pursuant to paragraph one, no driver of a taxi shall charge a fare in excess of the amount agreed upon with the passenger and such passenger shall pay the fare in the amount agreed upon.

The provision in paragraph two shall also apply to the taxis of the types not being prescribed in the royal decree pursuant to paragraph one.

    1. Driver, while driving a taxi, shall not

  1. smoke, play a radio or act in any manner that is a nuisance to the passengers

  2. extend a hand, arm or any part of the body out of the vehicle except in displaying signals pursuant to Section 37

  3. control the steering wheel with only one hand, except when necessary

  4. use sound signals when entering into the area of a hospital, office or educational institute

  5. use horn sound signals to press other vehicles

  6. overtake or dash in front of other vehicles haphazardly and dangerously

  7. drive into a person’s house area

  8. pick up a passenger in an area prescribed by the traffic officer with a traffic sign prohibiting picking up of passengers

  9. use impolite words, speak sarcastically at, insult, abuse or act in such manner to the passengers or other persons.

    1. The driver of a taxi shall convey his passengers through the shortest route or a reasonable detour and shall deliver them at the place agreed upon.

    2. Driver of a taxi shall not forsake his passengers on the way in any circumstance

    3. The driver of a taxi shall dress in a uniform on which a mark embroidered.

The characteristics of the uniform and the mark shall be as prescribed by the Director General and announced in the Government Gazette.

The provision in paragraph one shall become effective upon the expiration of the sixty day period after the effective date of the announcement of the Director General.

    1. If Minister deems it appropriate to have the persons engaged in the employment of conveying passengers by taxis in any locality park the vehicles at any particular place, he may execute such by issuing a royal decree.

In the said royal decree, localities and the proceeding in providing the vehicle parks shall also be specified.

Pedestrians

    1. A pedestrian shall walk on the footpath or road shoulder at the side of a roadway. If such footpath or road shoulder at the side of a roadway does not exist, he shall walk along the edge of the way on his right.

    2. Pedestrian shall not cross a way within one hundred meters from a pedestrian crossing except in the pedestrian crossing.

    3. A pedestrian who wishes to cross a roadway in a pedestrian crossing with a traffic light signal for pedestrians control, shall comply with the traffic light signals that appear in front of him as follows

  1. At a red light signal, whether with or without an illustration or statement prohibiting the pedestrians to cross the roadway the pedestrian shall stop and wait on the footpath, on the island that divides the roadway or in the safety some except in a way with no footpath where he shall and wait on the road shoulder or curb.

  2. At a green light signal whether with or without an illustration or statement permitting the pedestrians to cross the roadway, the pedestrian may then cross the roadway.

  3. At a blinking green light signal at either side of the say, the pedestrians who have not crossed the roadway shall stop and wait on the footpath on the island that divides the roadway or in the safety zone, but chose who are crossing the roadway shall continue to cross the roadway quickly.

    1. A pedestrian who wishes to cross a roadway at a crossing or junction with light signals for control of the use of the way shall act as follows;

  1. At a red light signal ordering the vehicles on one side of the way to stop, the pedestrian shall cross the roadway on such side and shall cross the roadway within the crossing;

  2. At a green light signal permitting the vehicles on one side of the way to pass, no pedestrian shall cross the roadway on such side

  3. At a yellow or blinking green light signal on one side of the way, the pedestrians who have not crossed the roadway on such side shall stop and wait on the footpath, on the island that divides the roadway or in the safety zone, but those who are crossing the roadway shall continue to cross the roadway quickly.

    1. A pedestrian who wishes to cross a roadway at the place where the competent officer displays traffic signals, whether by hands and arms or whistle sound signals, shall comply with Section 106 mutatis mutandis.

    2. Persons shall not walk in files or processions in the manner that obstructs the traffic, except;

  1. files of military or police personnel under the control of an officer according to the rules and practice;

  2. files or processions that the traffic officer permits and that comply with the conditions prescribed by the traffic officer.

    1. No person shall commit any act on a footpath or any other way provided for pedestrians in any manner that obstructs other persons without sufficient cause.

    2. No person shall buy or sell goods, distribute materials or solicit contributions in a roadway or in the middle of a way without sufficient cause or that obstructs the traffic.

Animals and Articles in Ways

    1. No person shall ride, pull, herd, or let loose animals on a way in the manner that obstructs the traffic and under inadequate control.

    2. A person who rides, pulls, or chases animals on a way shall comply with provisions of this Act on automobiles mutatis mutandis.

    3. The traffic officer shall have the power to order the prohibition of riding, pulling, chasing or letting loose animals on any way upon seeing that the said riding, pulling, chasing or letting loose of animals will obstruct the traffic or cause the way to be dirty.

    4. No person shall place, set, extend or hang any article or commit any act in any manner that obstructs the traffic except with written permission from the traffic officer. However, the traffic officer may grant such permission only upon necessity and occasionally

A person who violates the provision in paragraph on is not only liable to punishment under Section 148 but also to being ordered by the traffic officer to tear down or remove the said obstructions. If he refuses to tear down or remove, the traffic officer shall have the power to tear down or remove.

    1. No person shall carry, pull or bring articles on a way in the manner that obstructs the traffic.

Horse Drawn Carriages and Bullock Carts

    1. Horse drawn carriage or a bullock cart with the animal hitched there shall not be left standing on a way without a person in charge, unless the animal is so tied as to prevent if from moving the said carriage or cart.

    2. The driver of the horse drawn carriage shall not release the rein while driving the cart.

    3. In driving the horse drawn carriage or bullock cart, the driver shall comply will the provision of this Act relating to vehicles, mutatis mutandes.

Safety zone

    1. Driver is not allowed to drive a vehicle into the safety zone, except in case it is necessary and permission has been obtained from the traffic officer or the competent officer.

Miscellaneous

    1. The driver shall not drive backwards in the manner which is not safe or obstructing the traffic.

    2. The rider of the motorcycle shall sit on the saddle, provided for the motor cycle rider. If the competent officer specifies in the registration to be able to carry passengers, the passenger shall ride on the pillion at the back of the motor cycle rider and on the seat provided for the passenger or in the side car

    3. The rider of the motor cycle and the passenger of the motor cycle shall wear special helmet for protection against harm while riding and being passenger on the motor cycle

The manner and method of wearing the safety helmet under paragraph one shall be in accordance with Ministerial Regulation.

The provision under this Section does not apply to monks, novices, ascetic and persons who respect other religion or traditionally wear a turban. Or other persons excepted under Ministerial Regulation.

    1. The driver of a motor car shall not allow more than two other persons to sit in the front row next to the driver/s seat. The driver of the motor car shall fasten his body with the safety belt while he is driving his motor car and require passengers in front of row to fasten their seat belts while the car is in motion.

    2. Passengers shall not act in any manner that prevents the driver from seeing the way in front and on the sides of the vehicle conveniently or in any manner that obstruct the control of the vehicle

Passenger shall not perch, hang or stretch any organ of body out of the motor car that causes the danger while the motor car is running on the roadways.

No a person shall get in or get off bus or school bus or taxi while the vehicle is stopped and waiting for traffic light or traffic obstruction.

The driver or conductor of passenger bus or school bus or taxi shall not permit passengers to do anything under paragraph one or three.

    1. When driving through a narrow pass between mountains or hills or when driving in roadway on a mountain or hill, the driver of a vehicle shall keep close to the curb on the left hand side and upon arriving at a curve shall use sound signals to give a warning to another vehicle that may be coming in the opposite.

    2. Driver of a vehicle shall not apply the neutral gear or engage the clutch which driving down a slope or shoulder of a hill.

    3. Driver of a vehicle shall not

  1. drive his vehicle closer than fifty meters behind an emergency vehicle which is performing its duty

  2. drive his vehicle into or park his vehicle in a fire zone

  3. drive his vehicle on top of a fire-hose with no protection while firemen are performing their duties except with permission of the firemen than on duty

    1. No person shall place, pour or throw pieces of broken glass, nails, wire, grease, empty cans or other materials or commit any action on a way that may cause danger or damage to vehicles or persons or obstruct the traffic.

    2. Any person who knows that any of the said materials pursuant to Section 128 under his control has fallen, leaked or flown on a way shall immediately remove such material out of the way.

    3. Person shall not burn or commit any action within a distance of five hundred meters from a roadway that causes smoke or other things likely to be dangerous to the traffic in such roadway.

    4. Any person who removes a broken down or ruined vehicle from a way shall also immediately remove all the broken parts of fallen articles that result from such break down or ruin.

    5. The owner or driver of a school bus shall arrange to have a SCHOOL BUS lettering of not less than fifteen centimeters in height fixed to the front and back of the vehicle while driving the vehicle out to pick up and deliver students.

The driver of a school bus with a red light signal at the front and back of the vehicle that flashes at intervals for other vehicles behind or passing in the opposite direction to see clearly shall not use such light signal and shall have the SCHOOL BUS sign concealed when he drives the vehicle out in a way for a purpose other than picking up and delivering students.

    1. A vehicle to be used in a procession or for advertising goods or entertainment in procession along ways shall required permission from the traffic officer except that such procession is an official activity.

A vehicle to be used for advertisement of goods or entertainment pursuant to paragraph one, if the procession has been permitted and the vehicle has been specified in the said permission, shall require no further permission.

    1. There shall be no vehicle-race in a roadway except with written permission from the traffic officer.

Power of the Traffic Officer and Competent Officer

    1. For the safety and convenience of the traffic, the traffic officer shall have the power to prescribe any area or location over which the owner of the land has given right of way as a way under this Act.

    2. The Director General shall have the power to appoint persons who have the qualification to be prescribed and pass the traffic volunteers training course to perform the duty in assistance to the duty performance of the competent officer.

The qualifications of the trainer, particulars of the traffic volunteers training course and duties of the traffic volunteers as well as their uniform and emblem shall be prescribed by the Director General.

    1. In performing his duty assigned to him under this Act. a traffic volunteer shall be an officer under the Criminal Code.

    2. In the event of an emergency or accident that causes the traffic in any area to be unsafe or inconvenient. The traffic officer or competent officer shall have the power to execute any action deemed appropriate or necessary in connection with the traffic in such area in order to bring about the safety and convenience in the traffic as follows

  1. to prohibit the entrance of vehicles of all or certain categories or pedestrians in any way or any part of any way:

  2. to prohibit the stopping or parking of vehicles in any way or any part of any way;

  3. to prohibit the turning, turning around or backing of vehicles in any way or any part of any way;

  4. to prescribe any way or any part of any way for a one-way traffic.

However, for a period deemed necessary.

    1. In any or any part of any way deemed suitable that with a notification of certain traffic rules and regulations it is sure to bring about the safety and convenience in the traffic, the traffic officer shall have the power to notify the rules and regulations as follows:

  1. to prohibit the use of vehicles of every or certain categories

  2. to prohibit the stopping or parking

  3. to prohibit the turning, turning around or backing of vehicles

  4. to prescribe a one-way traffic

  5. to prescribe time periods for vehicle parking in narrow ways or at critical places

  6. to prescribe speed limits within the rates prescribed in the Ministerial Regulations

  7. to prescribe traffic lanes or channels for up and down traffic

  8. to prescribe principal and secondary roadways

  9. to prescribe vehicle parking of vehicle parking lots

  10. to prescribe rules for the use of ways or traffic lanes for vehicles of certain categories

  11. to prescribe rules for the use of school buses

  12. to prescribe rules fro the conveyance of passengers on bicycles

  13. to control processions or public gatherings

  14. to control or prohibit the turning of vehicles at junctions

  15. to draw lines or make traffic marks on the surface of ways or install traffic signals or traffic signs

  16. to prescribe the distance at any part of the way that a vehicle may go beyond the middle line of the way made by the traffic officer

  17. to prescribe rules for the parking of damaged or ruined vehicles including a vehicle being repaired in the way

  18. to prescribe rules for the road crossing of pedestrians at a place where no pedestrians crossing exists

  19. to prescribe the use of vehicle lamps

  20. to prescribe the use of sound signals

  21. to prescribe rules for the permission and the use of vehicles with wheels or part of wheels touching the road surface being of non-rubber.

    1. Upon finding a vehicle driver violating or not complying with the provisions of the Act or the law on such vehicle, the traffic officer or competent officer may give a verbal warning to such driver or issue a written order to the driver to report at a police station or the office of the traffic officer, except an offence liable to the penalty pursuant to Section 160 that verbal warning shall not be applied. In the event of the driver is nowhere to be found. a written order shall be left on the vehicle at a conspicuous place

In issuing a written order to a drive to report to a police station or the office of the traffic officer or the competent official, the traffic officer or the competent officer may temporarily seize the driving license by issuing a driving license replacement, but the competent official must deliver such driving license to the officer pursuant to Section 145 within eight hours from the time of the issue of the written order.

A driving license replacement issued pursuant to paragraph two shall be valid for use in lieu of the driving license for a period not exceeding seven days. After the competent officer pursuant to paragraph two having given a verbal warning to or having imposed a fine on the drive and the fine having been duly paid, he shall immediately return the driving license to the driver, except in the case for the procedure for the seizure of such pursuant to Section 161 when the traffic officer or competent officer is required to issue a driving license replacement for use in lieu of the driving license for a period not exceeding fifteen days.

The written order and the driving license replacement shall be in accordance with the forms prescribed by the traffic officer.

    1. A driver who is given a written order pursuant to Section 140 shall comply in the following cases:

  1. To pay a fine pursuant number notified in 2 written order or under number notified by Traffic officer or Competent Officer at location fixed by Director General in Government Gazette.

  2. To pay a fine pursuant number notified in written order by sending money-order or bank check with copy of written order to Director General.

In case of the Traffic Officer or the Competent Officer has taken driver’s license, the Traffic Officer shall give driver’s license to drive who has received a written order immediately.

Section 141 bis. In case of driver or vehicle owner who has received a written order but he does not comply with Section 141. The examining officer has a power following.

    1. If it appears that a driver has taken a vehicle in poor condition under Section 6 to use on the roadways, he shall be punished under that provision and the traffic officer or the competent officer is empowered to issue a written order to him to repair his vehicle.

Section 143 bis. If it appears that a driver is using in a way a vehicle whose condition is not correct according to Section 5. Besides the driver being liable to penalty under such provisions the traffic officer or competent officer shall have the power to order him or the owner to have the vehicle put right.

    1. After the owner or driver having repaired or modified the vehicle in accordance with the order of the traffic officer or competent office pursuant to Section 143 such vehicle shall be brought to the traffic officer or the person appointed by the Director General for inspection and certification, and the owner or driver shall put the vehicle to use in a way only after having obtained the said certificate.

The inspection and certification pursuant to paragraph one shall be in accordance with the prescriptions in Ministerial Regulations.

    1. The Investigation Officer shall have the power to investigate all the offences under this Act in accordance with the law on criminal procedures except the offences under Section 160 paragraph two and shall have the power to impose fines or give verbal warnings

    2. The fine payments under this Act obtained in Bangkok Metropolis or any Changwat or any locality specified in the Notification of the Ministry of Interior shall be given in part to the Bangkok Metropolis or the Municipality of such Changwat for traffic management or wholly allocated to the locality specified in the Notification of the Ministry of Interior.

Penalty Provisions

    1. Any person who violates or does not comply with Section 12. Section 79, Section 80. Section 82, Section 103, Section 104, Section 105, Section 106, Section 115, Section 116, Section 117, Section 131 or Section 132 is liable to a fine of not exceeding two hundred Baht.

    2. Any person who violates or does not comply with Section 6 paragraph one or paragraph two, Section 8 paragraph one, Section 9, Section 10, Section 11, Section 14, paragraph one, Section 20, Section 36, Section 37, Section 38, Section 41, Section 42, Section 44, Section 51, Section 54, Section 55,paragraph one, Section 57, Section 58, Section 60, Section 62, Section 63, Section 68, Section 69, Section 70, Section 71, Section 73 paragraph two, Section 74, Section 76, Section 83 Section 84, Section 87, Section 88, Section 96 paragraph one, Section 97, Section 100 Section 107, Section 108, Section 109, Section 110, Section 111, Section 112, Section 114, paragraph one. Section 118, Section 119, Section 120, Section 121, Section 122, Section 123, Section 124, Section 126, Section 129 or Section 133 is liable to a fine of not exceeding five hundred Baht.

    3. Any person who does not comply with Section 98 paragraph two or paragraph three is liable to a fine of not exceeding five hundred Baht.

    4. Any person

  1. who does not comply with the rules or notification prescribed by the Director General pursuant to Section 8 paragraph two or Section 14 paragraph two

  2. who does not comply with the conditions prescribed by the Director General pursuant to Section 13 paragraph two

  3. who does not comply with the Ministerial Regulation issued under Section 18

  4. who violates the order of the traffic officer given under Section 113

  5. who violates the order of the traffic officer or competent officer given under Section 140 paragraph two is liable to a fine of not exceeding five hundred Baht.

    1. Any person who violates or does not comply with Section 7. Section 13 paragraph one , Section 15 paragraph one, Section 16, Section 21 paragraph one. Section 22, Section 23 <1>, Section 24, Section 25, Section 26, Section 29, Section 49, Section 50, Section 56, Section 64, Section 67 paragraph one, Section 73 paragraph one or three, Section 77 paragraph one, Section 85, Section 86, Section 89 paragraph one, Section 90, Section 91, Section 92, Section 93, Section 94 paragraph one, Section 95, Section 99, Section 127, Section 128, Section 130 or Section 134 or does not comply with the notification prescribed by the Director –General pursuant to Section 15 paragraph two or does not comply with the Ministerial Regulation issued under Section 77 paragraph two or Section 96 paragraph two is liable to a fine of not exceeding one thousand bath.

    2. Any person who engages in taking employment to convey passengers by a taxi and does not park his vehicle at the place prescribed by a royal decree issued under Section 102 is liable to a fine of not exceeding one thousand Baht.

    3. Whoever:

  1. violates the orders of the officers as prescribed in the section 138 paragraph one or the Section 142 paragraph one

  2. violates the orders, rules or the regulations of the traffic officers as prescribed in the Section 139

  3. violates the orders of the officers as prescribed in the Section 142 paragraph two or

  4. violates the orders of the officers as prescribed in the Section 143 bis

If not otherwise stated as an offence in this Act, the offenders may be fined one thousand Baht for one time

  1. Any person who does not comply will Section 141 without adequate cause is liable to a fine of not exceeding one thousand Baht.

  2. Any person who brings a vehicle ordered by the traffic officer or competent officer to be repaired or modified by the owner or driver pursuant to Section 143 to use in a way without the certificate pursuant to Section 144 is liable to a fine of not exceeding one thousand Baht or to a fine on a daily basis at the rate of fifty Baht per day until correct compliance is effected.

  3. Any person who violates or does not comply with Section 35, Section 43, Section 45, Section 46, Section 47, Section 48, Section 53, Section 65 paragraph one or Section 125 is liable to a fine from four hundred to one thousand Baht.

Section 157. bis. Any driver who violates or does not perform as the officers ordered under Section 43 bis or Section 43 ter must be punished not exceeding one thousand Baht.

Any driver who violates the Section 43 bis paragraph one the violator shall be liable to punishment more than the punishment in the law on narcotic for one third and the court shall order to suspend the license for not less than six month or revoke the license.

If the offence prescribed in the Section 43 bis may cause the grievous harm to the other person the offender shall be liable to imprisonment for a term from two years to six years and further a fine from forty thousand Baht to one hundred and twenty thousand Baht and the court shall revoke the license. If the offense causes the other person to be die, the offender shall be liable to imprisonment for a tern from three years to ten years and a fine from sixty thousand Baht to two hundred and twenty thousand Baht and the court shall revoke the license.

  1. Any person who violates or does not comply with Section 17 paragraph one, Section 28 or Section 100 paragraph one or paragraph two, or does not comply with the ministerial Regulation issued under Section 17 paragraph two is liable to an imprisonment for not exceeding one month or to a fine of not exceeding two thousand Baht or to both.

  2. Any person who violates and order of the traffic officer or competent officer given under Section 59 paragraph one is liable to an imprisonment for a period not exceeding one month or to a fine of not exceeding two thousand Baht or to both.

  3. Any person who does not comply with Section 78 is liable to an imprisonment for a period not exceeding one month or to a fine of not exceeding two thousand Baht or to both.

If non compliance with Section 78 is a cause of a serious injury or death. Such responsible person is liable to an imprisonment for a period not exceeding three months or to a fine of not exceeding five thousand Baht or to both.

Section 160 bis : Anyone, who violates Section 134, shall be punished by being taken into prison not less time than three months or is liable to fine not exceeding ten thousand Baht or both fine and prison, and the court shall or both fine and prison, and the court shall forbid to use the license not less time than one month or revoke the license.

  1. In the event of a driver having committed an offence under this Act, the Commander of the Bangkok Metropolitan Police, the Commander of the Provincial Police, the Commander of the Traffic Police, the Commander of the Highways Police or the person authorized by the said officers shall have the power to seize and hold the driving license of such driver for not exceeding sixty days at a time.

The driver whose driving license is seized pursuant to paragraph one may appeal to the Director General within fifteen days from the day of the seizure of the driving license.

The Director General shall consider the petition and give the decision to either seize or not seize the driving license within one month from the day of receipt of the appeal. Such decision of the Director General shall be final.

  1. In a lawsuit that a driver is convicted by the final judgment of the Court for the commission of an offence under this Act or the law governing such vehicle, besides the penalty that such driver is liable under such provision but, if it appears to the Court that the driver is likely to cause danger to persons or property of other persons if allowed to drive, the Court shall have the power to order the suspension or revocation of the driving license of such person.

  2. With regard to a lawsuit that there is a commission of an act that violates or does not comply with the provision of the Act or the law governing such a vehicle. if such violation or non –compliance has caused damage to the traffic signals or traffic sings installed by the competent officer, the Public Prosecution Officer, upon prosecuting the offender, shall demand for compensation for the damage inflicted upon the said traffic signals or traffic signs.
