Завданнями кримінального судочинства в Україні є охорона прав та законних інтересів фізичних і юридичних осіб, які беруть в ньому участь, а також швидке і повне розкриття злочинів, викриття винних та забезпечення правильного застосування Закону з тим, щоб кожний, хто вчинив злочин, був притягнутий до відповідальності і жоден невинний не був покараний. Згідно з Кримінально-процесуальним кодексом України
кримінальне судочинство складається із кількох частин: 1) порушення кримінальної справи; 2) досудове (попереднє) розслідування (дізнання та досудове слідство); 3) віддання до суду; 4) судовий розгляд; 5) апеляційне провадження; 6) касаційне провадження; 7) виконання вироку. Перша стадія — порушення кримінальної справи — починається з моменту надходження до органу дізнання, слідчого, прокурора або суду заяви або повідомлення про злочин. У даній стадії процесу орган дізнання може затримати особу, підозрювану у здійсненні злочину, на 72 години. Попереднє розслідування полягає у провадженні органами дізнання та попереднього слідства передбачених законом слідчих та інших процесуальних дій, спрямованих на отримання доказів, попередження, припинення, швидке та повне розкриття злочину, всебічне дослідження обставин справи та викриття винних, виявлення та усунення причин і умов, які сприяли вчиненню злочину, відшкодування завданої злочином шкоди, забезпечення відповідальності осіб, які вчинили злочин, і правильне застосування закону. У цій стадії кримінального процесу особі, яка вчинила злочин, пред’являється обвинувачення і надається право мати захисника та захищатись самому всіма передбаченими законом засобами. Стадія порушення кримінальної справи закінчується винесенням постанови про порушення кримінальної справи або постанови про відмову в порушенні кримінальної справи. В останньому випадку кримінальний процес не знаходить продовження.
