I. Read the following text and compare Criminal Code with Economic Crime in Russia and Belarus New Criminal Code to Deal with Economic Crime

On January 1, 1997, a new Criminal Code came into force in Russia. The new Criminal Code focuses on four categories of economic crimes.

The first group of crimes includes the breaching of economic freedom that prevents normal business activity from taking place, or just blocking market competition. The government can prosecute officials for obstructing lawful business activity and registering illicit deals in land. Illegal monopolistic actions in the market and business-related bribes, such as bribing the organizer of a tender, are also dealt with in the code.

The second group concerns consumers' rights. As from January 1997, it will be against the law to manufacture inferior goods and use misleading advertising. Those who falsely advertise their products will be liable to prosecution.

The third group deals with financial crimes. Any violation of financial and stock-market rules will provide grounds for prosecution. Thus violation of regulations on the issuance of securities, forging credit cards and other payment documents and deliberate bankruptcy are included in this category. Forged securities, whether government or corporate, now will also be considered a criminal activity.

The fourth group deals with the state's economic security. Smuggling and illicit dealings in foreign exchange, although, under the new Code, only illicit operations involving precious metals and gems will be punishable, and currency-exchange operations do not constitute a crime. Thus the grounds for prosecution include business frauds, illegal banking operations, issuance of title deeds to property and funds which where obtained by criminal means.

The new Code contains a much longer list of actions considered as criminal and their respective punishments. The framers of the Code replaced imprisonment with fines wherever possible. It seems that in some cases a fine is more effective than jail /not an administrative fine, but a court-imposed one which is bound to bring a greater disgrace on the wrongdoer. Opponents of the new code vehemently denounced this approach, asserting that the rich would only pay fines but the poor would have to serve time for the same crime. This argument is invalid according to the Code's supporters: both will go to prison, but the rich would have to pay a fine too.

The new Code contains new anticorruption provisions. It was the job of security services of companies to fight bribery among its company officials. The new Code makes bribery among or by businessmen punishable (Article 204, "Bribery in Business", and Article 184, "Bribing Participants in, and Organizers of Professional Sports Competitions and Spectacular Commercial Competitions). It will be difficult, thought, to apply criminal sanctions against bribe takers in non-governmental organizations.
