Text 1 What Is a Trademark or Servicemark?

A trademark is a word, name, symbol, or device that is used in trade with goods to indicate the source of the goods and to distinguish them from the goods of others.	Знак для товарів і послуг – це слово, назва, символ чи пристрій, який використовується у торгівлі товарами, щоб вказати джерело товарів та відрізнити їх від товарів інших виробників.
A servicemark is the same as a trademark except that it identifies and distinguishes the source of a service rather than a product.	Знак обслуговування - це те саме, що й знак для товарів і послуг, за винятком того, що він ідентифікує та відрізняє джерело послуги, а не виробу.
Trademark rights may be used to prevent others from using a confusingly similar mark, but not to prevent others from making the same goods or from selling the same goods or services under a clearly different mark.	Права на знаки для товарів і послуг можуть використовуватися для попередження застосування випадково подібного знака, але не захищають від виробу чи продажу таких самих продуктів чи послуг під абсолютно іншим знаком.
Trademarks which are used in interstate or foreign commerce may be registered with the USPTO (United States Patent and Trademark Office).	Знаки для товарів і послуг, що використовуються у міжнародній чи у зовнішній торгівлі, можуть бути зареєстрованими у Відомстві з патентів та знаків для товарів і послуг США.
A trademark is registered in the name of a legal entity or an individual entrepreneur.	Знак для товарів і послуг реєструється на ім’я юридичної особи чи приватного підприємця.
The owner of a registered trademark is granted a certificate of registration for the trademark which attests to the fact that the trademark has been registered, its priority and also the exclusive right to use the trademark in relation to the goods indicated in the trademark certificate.	Власнику зареєстрованого знака для товарів і послуг надається свідоцтво про реєстрацію цього знаку, яке підтверджує, що знак для товарів і послуг був зареєстрований, а також підтверджує його пріоритет та виключне право на його використання відносно товарів, вказаних у свідоцтві про реєстрацію.
Verbal (including words, numbers, letters and names), illuminated, three-dimensional, acoustic and any other form of designations, or a combination thereof, may be registered as trademarks. They can be registered in any color or combination of colors.	Як знак для товарів і послуг можуть бути зареєстровані словесні позначення (включаючи слова, числа, букви та назви), світлові, об’ємні, звукові чи будь-яки інші форми, чи їх комбінації. Вони можуть бути зареєстровані у будь-якому кольорі чи комбінації кольорів.
A trademark is considered to be used when it is placed on goods for which the trademark is registered, and/or their packaging. It is also considered to be used when it is applied in advertising, publications, official forms, signboards, and displays of exhibits at exhibitions only in cases where the mark cannot be displayed on goods and /or their packing.	Знак для товарів і послуг вважається використаним, якщо він розташований на тих самих товарах, для яких він зареєстрований, та/або на їх упаковці. Він також вважається використаним, якщо він використовується у рекламі, публікаціях, офіційних бланках, вивісках чи на експонатах виставок тільки в тих випадках, коли він не може бути вказаним на товарі чи упаковці.
