Текст 2 Знаки для товарів і послуг
У США діє закон про знаки для товарів і послуг. Знаки для товарів і послуг можуть бути словесними, зображальними і звуковими, простими і комбінованими.
Власник знаку для товарів і послуг використовує його перш за все для маркування певного кола товарів, що виготовляються або реалізуються на території, де діє виняткове право на знак, щоб відрізнити своє підприємство, яке виробляє товари чи надає різні послуги, від інших.
У США щотижня окремим виданням виходить з друку “Офіційний бюлетень Відомства з патентів і знаків для товарів і послуг Сполучених Штатів. Знаки для товарів і послуг”.
Велике місце займає розділ “Marks Published for Opposition” (див.Фіг.4), де публікуються заявки на знаки для товарів і послуг, що виставлені для подання заперечень.
Про кожен знак для товарів і послуг наводяться такі дані:
- номер заявки на знак для товарів і послуг (перед номером ставлять літери “S.N.”–серійнийномер;
- найменування і місцезнаходження особи/ організації, що подає заяву;
- дата подання заявки на знак для товарів і послуг ;
- знак для товарів і послуг;
- індекси міжнародної класифікації товарів і послуг;
- перелік товарів, для яких призначений знак;
- дата першого використання знаку для товарів і послуг(First).
У розділі “Patent and Trademark Office Notices” друкуються офіційні матеріали: постанови, повідомлення законодавчого характеру, відомості про кількість поданих на реєстрацію заяв і т.п.
Marks published for opposition
The following marks are published in compliance with section 12a of the Trademark Act of 1946. Applications for the registration of marks in more than one class have been filed as provided in section 30 of said act as amended by Public Law 772 , 87th Congress, approved Oct. 9, 1962, 76 Stat. 769. Opposition under section 13 may be filed within 30 days of the date of this publication. See rules 2.101 to 2.105.
A separate fee of 200 hundred dollars for opposing each mark in each class must accompany the opposition.
Section 1. – international classification
The short titles associated below with international class numbers are terms designed merely for quick identification and not an official part of an international classification. The full names of international classes are given in section 6.1 of the trademark rules of practice.
The designation “US Cl.” appearing in this section refers to the US class in effect prior to September 1, 1973 rather than the international class which applies to application filed on or after that date. For adoption of international classification see notice in the “Official Gazette” of January 26, 1973 (911 O.G. TM210).
