Відповідно до сучасних норм міжнародного права збройні конфлікти можна поділити на міжнародні і внутрішні13. Класичним прикладом внутрішнього збройного конфлікту є громадянська війна. Незалежно від форми конфлікту ворогуючі сторони зобов’язані дотримуватись норм міжнародного гуманітарного права. Особи, які порушують ці норми під час війни або воєнних дій, можуть бути визнані воєнними злочинцями. В Україні передбачено кримінальну відповідальність осіб за скоєння воєнних злочинів та злочинів проти миру і людства.
За часів “холодної війни” та біполярного світу протистояння держав призвело до численних локальних війн і конфліктів. Ядерна зброя була стримуючим фактором для запобігання черговій світовій війні. Проте в жодній обмеженій або локальній війні міжнародне співтовариство не спромоглося ідентифікувати агресора та покарати винних. Відтепер ніхто не оголошує війну, оскільки така дія автоматично підпадає під визначення агресії. Воєнні дії фактично розпочинаються разом із взаємними звинуваченнями сторін. Тому в усіх офіційних міжнародних документах замість терміна “війна” вживається термін “збройний конфлікт”.

National Security
National security is commonly devised as preparedness for military action, protection of resources considered critical to the functioning of a nation to protect a country from attack or subversion.
It is a collective term encompassing both national defense and foreign relations of a country, specifically, the condition provided by: 1. a military or defense advantage over any foreign nation or group of nations, or 2. a favorable foreign relations position, or 3. a defense posture capable of successfully resisting hostile or destructive action from within or without, overt or covert15.
The concept of national security is based on a national security strategy – the art and science of developing, applying, and coordinating diplomatic, economic, military, and informational instruments of the national power – to achieve objectives that contribute to national security.
The concept of national security and defense is also based on national military strategy – the art and science of distributing and applying military power (i.e. the military and paramilitary forces) to attain national objectives in peace and war.
The military forces of a nation are called armed forces. The term is used to denote collectively all components of the Army, Navy, Air Force and other armed services.
National objectives are the aims, derived from national goals and interests, toward which a national policy or strategy is directed and efforts and resources of the nation are applied. The national policy is commonly recognized as a broad course of action or statements of guidance adopted by the government at the national level in pursuit of national objectives.
Moreover, the concept of national defense and security is interwoven with the notions of national security interests – the foundation for the development of valid national objectives that define country’s goals or purposes. For example, the US national security interests include “preserving US political identity, framework, and institutions; fostering economic wellbeing; and bolstering international order supporting the vital interests of the
United States and its allies”16.

National security is based on the constitution, laws, international treaties, agreements, doctrines, concepts, and other legal acts17.
Various organizations and agencies are directly concerned with national security issues. In Ukraine, for instance, there is a governmental body – the Council of National Security and Defense of Ukraine (CNSDU) – specifically designed to assist the President (who is the Head of the Council under the Costitution) in pursuing national security policy. The CNSDU also comprises the Head of the Verkhovna Rada of Ukraine, the Primeminister of Ukraine, the Council’s Secretary, the Minister of Emergencies and Population Protection from the Consequences of Chornobyl Catastrophe, the Minister of Foreign Affairs of Ukraine, the Minister of Defense of Ukraine, the Head of the Presidential Administration, the Minister of Finance of Ukraine, the Head of the State Border Guard Service of Ukraine, the President of the National Academy of Science of Ukraine, the Head of the Security Service of Ukraine, the Minister of Internal Affairs of Ukraine, the Minister of Justice of Ukraine, the Chief of the General Staff of the Armed Forces of Ukraine, the Minister of Economics of Ukraine.
The principles and tasks of the CNSDU activity are determined by the Law of Ukraine “On Council of National Security and Defense of Ukraine” of 1998 and the Concept of National Security and Defense of Ukraine, ratified by the Verkhovna Rada of Ukraine in 1997. The Law defines functions and authorities of the Council in peace and war, its organizational structure and membership, members’ duties etc.

Основні засади державної політики, спрямованої на захист національних інтересів і гарантування в Україні безпеки особи, суспільства і держави від зовнішніх і внутрішніх загроз, визначаються Законом України “Про основи національної безпеки України” від 19 червня 2003 року.
Відповідно до цього Закону розробляються і затверджуються Президентом України Стратегія національної безпеки України і Воєнна доктрина України, що є документами, обов’язковими для виконання, і основою для розробки інших програм за напрямами державної політики національної безпеки.
Правову основу у сфері національної безпеки України становлять Конституція, закони України, міжнародні договори, а також інші нормативно-правові акти.

Національні інтереси – це життєво важливі матеріальні, інтелектуальні і духовні цінності українського народу як носія суверенітету і єдиного джерела влади в Україні, визначальні потреби суспільства і держави, реалізація яких гарантує державний суверенітет України та її прогресивний розвиток.
Загрози національній безпеці – це наявні та потенційно можливі явища і чинники, що створюють небезпеку життєво важливим національним інтересам України.
Сукупність органів державної влади, військових формувань, утворених відповідно до законів України, діяльність яких перебуває під демократичним цивільним контролем з боку суспільства і безпосередньо спрямована на захист національних інтересів України від зовнішніх загроз, називається воєнною організацією держави.
Таким чином, національна безпека визначається як захищеність життєво важливих інтересів людини і громадянина, суспільства і держави, що забезпечує сталий розвиток суспільства, своєчасне виявлення, запобігання і нейтралізацію реальних та потенційних загроз національним інтересам.

National security strategy and national military strategy, shaped by and oriented on national security policies, provide strategic direction for combatant commanders. Combatant commanders, in turn, provide guidance and direction through their combatant command strategies and plans for the employment of military forces. These strategies integrate national and military objectives (ends), national policies and military concepts (ways), and national resources and military forces and supplies (means).
The US approaches its global commitments with a strategy founded on deterrence. Successful military operations may not, by themselves, achieve the desired strategic end state. Military activities need to be synchronized with other instruments of national power and focused on common national aims.
National military strategy (NMS)21 is derived from the national security strategy. National military strategy attempts to promote peace, deter aggression, and, failing that, fight and win. But in the larger context, defeating an enemy military force is rarely sufficient to ensure a long-term solution to a crisis. The national military strategy and defense policy provide strategic guidance for the employment of military forces. The National Military Strategy provides advice of the Chairman of the Joint Chiefs of Staff, in consultation with the other members and the combatant commanders, to the President, the National Security Council, and the Secretary of Defense as to the recommended military policy and force structure required to attain the national security objectives.
