Общие условия поставки 1. Базис и объем поставки

1.1. При морских перевозках поставки осуществляются на ус­ловиях ФОБ ПОРТ страны Про­давца, при этом:

а) Продавец несет все расходы по поставке товара на условиях ФОБ со штивкой, включая стои­ мость морской упаковки, мар­ кировки, сепарационных и кре­ пежных материалов, крановые и доковые, портовые и таможенные сборы, стоимость перемещения груза на причале, погрузки на борт и в трюм судна, укладки в трюме, а также дополнительные расходы по погрузке, если они будут иметь место;

б) право собственности на то­ вар, а также риск случайной его

General Conditions of Delivery 1. Basis and volume of delivery

1.1. When sea transportation, deliveries are made on FOB terms Seaport of the Sellers country and:

a) The Sellers shall bear all charges for the goods FOB port stowed, including cost of sea packing, marking, separation and fastening materials, dock and port dues, cranage and customs duties, cost of transfer of the cargo on the pier, loading on board the ship, loading and stowing into the hold as well as extra loading charges, if any;

b) the title to the goods as well as the risk of accidental loss or damage

утраты или повреждения перехо­дит с Продавца на Покупателя после погрузки товара на борт суд­на и укладки его в трюмах;

в) датой поставки считается дата «чистого» бортового коноса­мента.

1.2. При железнодорожных пе­ ревозках поставки осуществляют­ ся на условиях франко-вагон гра­ ница страны Продавца, при этом:

а) Продавец несет все расходы по транспортировке товара до го­ сударственной границы своей страны; расходы по дальнейшей транспортировке, по погрузке и/ или перестановке колесных пар несет Покупатель;

б) право собственности на то­ вар, а также риск его случайной утраты или повреждения перехо­ дит с Продавца на Покупателя с момента передачи товара желез­ ной дорогой страны Продавца же­ лезной дороге страны Покупате­ ля или страны транзита;

в) датой поставки считается дата штемпеля на железнодорож­ ной накладной пограничной стан­ ции, принявшей товар от желез­ ных дорог страны Продавца, под­ тверждающая переход границы.

1.3. При автомобильных пере­ возках поставки осуществляются на условиях франко-место погруз­ ки товара на транспортные сред­ ства Покупателя, при этом:

c) the date of Clean on Board Bill of Lading is to be considered as the date of delivery.

1.2. When railway transporta­ tion, deliveries are made Free on rail the frontier of the Sellers' country, and:

1. The Sellers shall bear all the transportation charges to the State frontier of their country; the subsequent charges for transportation, and/or change of railway carriage wheels shall be borne by the Buyers;

2. the title to the goods as well as the risk of accidental loss or damage to the goods shall pass from the Sellers to the Buyers since the moment the goods have been handed over by the railway of the Sellers' country to the railway of the Buyers' country or the transit country railway;

c) the date stamped on the Railway Bill by the frontier station which has received the goods from the railway of the Sellers' country confirming the crossing of the frontier to be considered as the date of delivery.

1.3. When motor transportation, deliveries are made free Place of loading the goods on transportation facilities of the Buyers, and:

а) Продавец несет все расходы по транспортировке товара до ме­ ста, в котором производится по­ грузка товара на транспортные средства Покупателя;

б) право собственности на товар, а также риск его случайной утра­ ты или повреждения переходят с Продавца на Покупателя с момен­ та принятия товара на транспорт­ ные средства Покупателя;

в) датой поставки считается дата документа, подтверждающе­ го принятие товара транспортны­ ми средствами Покупателя.

1.4. При воздушных перевозках поставки осуществляются на ус­ ловиях франко-борт самолета «Аэрофлота» в аэропорту отправ­ ления, при этом:

а) Продавец несет все расходы до момента погрузки товара на борт самолета в своей стране;

б) право собственности на то­ вар, а также риск его случайной утраты или повреждения перехо­ дят с Продавца на Покупателя с момента его погрузки на борт са­ молета в стране Продавца;

в) датой поставки считается дата грузовой накладной воздуш­ ного сообщения.

1.5. При почтовых отправлени­ ях поставки осуществляются на условиях франко получатель страны Покупателя, при этом:

a) The Sellers shall bear the transportation charges till the Point where the goods are loaded on the Buyers' transportation facilities;

2. the title to the goods as well as the risk of accidental loss or damage to the goods shall pass from the Sellers to the Buyers since the moment the goods have been transferred from the Sellers' transportation facilities to the Buyers' transportation facilities;

3. the date of delivery is the date of document confirming the acceptance of the goods by the Buyers' transportation facilities.

1.4. When air conveyance, deliveries shall be made Free on the plane of "Aerof lot" in the airport of departure and:

1. The Sellers shall bear all the charges up to the moment of loading the goods on board of the plane in their country;

2. the title to the goods as well as the risk of accidental loss or damage to the goods shall pass from the Sel­lers to the Buyers the moment when the goods have been loaded on board the plane in the Sellers' country;

3. the date of the Airfreight Bill is considered as the date of delivery.

1.5. When dispatched by parcel post deliveries shall be made free consignee in the Buyers' country and:

а) Продавец несет все расходы по транспортировке до пункта на­ значения;

б) право собственности на то­ вар, а также риск его случайной утраты или повреждения перехо­ дят с Продавца на Покупателя с момента сдачи посылки почтово­ му ведомству страны Продавца; при этом с момента сдачи посылки почтовому ведомству страны Про­ давца право требования по дого­ вору перевозки, заключенному с почтовым ведомством, переходит с Продавца на Покупателя;

в) датой поставки считается дата штемпеля на почтовой кви­ танции.

1.6. Для обеспечения нормаль­ной работы поставляемого обору­дования с производительностью и другими показателями, предус­мотренными в настоящем кон­тракте, Продавец обязуется:

а) передать Покупателю име­ ющийся у него опыт и знания по эксплуатации и ремонту постав­ ляемого оборудования;

б) по просьбе Покупателя обес­ печить обучение на аналогичном действующем оборудовании рос­ сийского персонала по согласован­ ной сторонами программе;

в) по просьбе Покупателя поста­ вить запасные части, позволяющие нормально работать на оборудова­ нии после истечения гарантийного периода, по спецификации и ценам,

1. The Sellers shall bear all the charges to the place of destination;

2. the title to the goods as well as the risk of accidental loss or damage to the goods shall pass from the Sellers to the Buyers since the mo­ment the parcel has been handed over to the Post Office of the Sellers' co­untry; the right to demand under the agreement of conveyance concluded with the Post Office of the Sellers' country shall pass from the Sellers to the Buyers since the moment the parcel has been handed over to the Post Office of the Sellers' country;

3. the date of the stamp of the Post Office receipt is to be conside­red as the date of delivery.

1.6. To ensure normal operation of the equipment to be delivered with the capacity and other indices stipulated in the present Contract, the Sellers undertake:

a) to provide the Buyers with the experience the Sellers possess for operation and repair of the equip­ ment to be delivered;

2. to provide under Buyers re­quest training of Russian specialists, at similar operating equipment in accordance with the programme agreed upon by the parties;

3. to supply under Buyers requ­est spare parts, which allow for the normal operation of the equip­ment upon expiration of the gua­rantee period, according to the
