40 Тезисов в осуждение убийцы
В России вновь заговорили о смертной казни. В высших эшелонах власти активно дискутируется вопрос об отмене моратория на высшую меру. И по ряду признаков можно предположить, что такое решение вполне может быть принято.
Либералы, конечно, возмутятся. Народное большинство одобрительно закивает – туда им, душегубам, и дорога. Радикалы обрадуются. Остальные промолчат.
Казнить или миловать? Вечный вопрос. Мы предлагаем читателям точку зрения писателя Михаила Веллера. По частностям с ним можно не соглашаться, но в целом Веллер безупречно логичен. Не хочешь, чтобы в России казнили, так и запиши в своем паспорте: моего убийцу пожалеть.
Под убийцей здесь понимается тот, кто признан судом виновным в убийстве без смягчающих обстоятельств. Убивший из садистских склонностей или из корысти, сознательно, с обдуманным намерением. Не из ревности, не в состоянии тяжкого душевного волнения, не по неосторожности, а также не из мести за близкого убитого человека. Он должен быть судим только судом присяжных, и все сомнения в доказательствах трактуются в пользу обвиняемого.
Обозначение проблемы
1. Современный закон цинично подменяет понятия «человек» и «убийца». Декларируя: «Право человека на жизнь священно» применительно к убийце, он имеет в виду в конкретном случае не жизнь жертвы или любого человека, но именно убийцы. Имеется в виду, что государство, а через него народ, общество не имеет права посягать на жизнь убийцы. Тогда следует сформулировать прямо: «Право убийцы на жизнь священно».
2. Тем самым юридически права на жизнь невинной жертвы и ее убийцы приравниваются. Разница в том, что жертва своим правом воспользоваться не сумела, но защитить право убийцы должен закон. Государство не сумело сохранить жизнь жертве, но уж жизнь убийцы сохранит всеми средствами, имеющимися в его распоряжении.
3. Тем самым фактически закон отказывается приравнивать жизнь жертвы к жизни убийцы. Одна отнята – вторая охраняется. Из пары «жертва – убийца» в конкретном случае государство охраняет жизнь убийцы. Равновесие нарушается в его пользу, как и равенство.
4. Жертва не гарантирована от убийства. Убийца гарантирован.
5. Преимущество убийцы перед жертвой очевидно: я тебя убиваю, а они меня не моги.
6. То есть каждый человек имеет право на убийство без риска быть за это убитым самому. Он режет ребенка или калеку, а государство при этом охраняет его жизнь от посягательств.
Религия и духовность
7. Запрет на казнь убийцы антирелигиозен и безнравственен по сути. Только в период глубочайшего нравственного кризиса, в период господствующей бездуховности можно списывать жертву со счета по принципу «Умер Охрим – и хрен с ним»: мол, погибшего не воротишь, его уже нет с нами. Во все времена люди верили, чувствовали, знали: тот, кого ты любил. Навсегда живет в тебе и с тобой, покуда жив ты сам. Если душа ушедшего, его любовь, боль и чаяния, не продолжают жить в тебе, не продленнее жизни физического тела, то все слова о религиозности и вере фальшивы и пусты. Боль жертвы, ее предсмертное отчаяние и последний крик о жалости и справедливости живут в тебе, или ты не человек, а лишенная души скотина. Страдания жертвы продолжаются в каждом, кто любил ее.
8. Если умирающая жертва, зная, что отмерены минуты, убивает убийцу, никто не посмеет отрицать ее право на это. И обещание, данное умирающему, всегда и у всех народов почиталось священным. Покарать своего убийцу – священное и последнее право жертвы.
9. И когда казнят убийцу – не суд карает его, не мститель и не палач. Это жертва карает своего убийцу через земную ипостась того, в ком продолжает жить ее душа.
10. Если бы Господь бог не хотел казни убийц, он бы не вложил в нас ничем не утешаемое жжение и боль живущих в нас душ, взывающих о каре убийцам.
11. Если бы Господь бог не хотел казни убийц, он миловал бы их в течение всей человеческой истории.
История и христианство
12. Христиане любят поминать всепрощение Христа. Но римские легионеры были лишь исполнителями приказа и закона. Христа казнили закон и государство – Рима и Израиля.
13. Выросшее из секты непротивленцев христианство насаждалось огнем и мечом. И все убийцы во славу веры отнюдь не преданы христианством анафеме и не прокляты во веки веков.
14. В истории цивилизаций убийце могли оставить жизнь, если он убил раба, холопа или убил в честном поединке. Объявлять священной жизнь любого садиста, убившего кого угодно, – достижение новой и новейшей истории.
15. Наша цивилизация создана суровыми людьми. Их законы позволили поднять цивилизацию до сегодняшних вершин. С сегодняшними законами и нравами общество давно стало бы легкой добычей любых бандитов и грабителей. Что мы и имеем нынче.
О тяжести наказания
16. Разница между Бытием и Небытием, Жизнью и Смертью принципиально несравнима с разницей между хорошей жизнью и плохой. Пожизненно заключенный живет! И полагать это наказание сравнимым с казнью убийцы – величайшая глупость или величайшее лицемерие.
17. Международные требования к содержанию заключенных, если говорить об убийцах, – это издевательство. Когда миллионы честных людей нищенствуют, нам предписывают заботиться о сытости и тепле для убийц.
О демократии
18. Опросы показывают: подавляющее большинство считают, что убийца заслуживает казни. А законодатели – избранные народом депутаты, которым народ доверил свои интересы, – вопреки этим самым интересам считают, что наоборот. Выставьте вопрос на всенародное голосование – и вы получите демократический результат!
19. Логично провести опрос: в случае своей смерти милуешь ты своего убийцу или казнишь? И делать пометку. Таким образом сохраняет жизнь убийце или нет сама жертва. Никто не посмеет счесть, что казнь жертвой своего убийцы не гуманна.
20. Кому выгоден запрет на смертную казнь? Прежде всего убийцам.
21. Кто может лоббировать запрет на смертную казнь? Финансово состоятельные структуры, которые решают критические вопросы криминальными методами.
22. Через кого может лоббироваться этот запрет? Через адвокатов, депутатов, судей.
23. Демократический Запад хлопочет о жизни для российских убийц. Не то даст меньше любви и денег. Но это вариант продажи крови жертв.
Высшие Ценности
24. Объявление жизни любого человека Высшей Ценностью – свидетельство кризиса и гибели цивилизации. Ибо тем самым отрицаются все надличностные ценности – героизм, патриотизм, самосожжение в труде и творчестве, верность любви, дружбе. Идеалам – все, что от века составляло смысл и гордость человеческого существования. Человек отличается от животного тем, что ему есть за что отдавать жизнь. Идеал справедливости выше жизни убийцы. Гуманисты могут считать, что убийца отдаст жизнь во имя идеала справедливости.
О справедливости
25. Воздаяние мерой за меру – первый закон справедливости.
26. Когда я страдаю по невинной жертве и не могу смириться с тем, что убийца жив, – это душа жертвы страдает и не может смириться во мне.
27. Когда платный адвокат, наемный защитник за деньги спасает жизнь изувера и публично объявляет извечные представления людей о справедливости атавизмом – этому закону и этому государству недолго осталось жить.
Самосуд
28. С трудом можно представить человека, который смиряется с тем, что жизнь убийцы его детей или родителей объявляется священной. Он хочет – и по возможности совершает – высший суд справедливости сам. Беря на себя функции, вверенные государству.
29. Люди, общественное мнение, коллективная совесть всегда оправдывали праведную месть. Это расшатывает государство: справедливым признается не оно, а тот, кто вступает с ним в конфликт, беря на себя его функции.
30. Карая за самосуд, государство являет свою тоталитарную, тираническую сущность: может, ты и прав, но будешь сурово наказан – как бы я ни поступал, но карать могу только я, снисходить к убийце – мое право, и любое покушение на мое право преступно.
Экономический эффект
31. Содержание пожизненно заключенных стоит денег. Честные люди, голодающие сегодня сами, не хотят кормить убийц.
32. От отсутствия в стране денег постоянно умирает множество людей – больные могли быть спасены, имей медицина средства на дорогие лекарства и аппаратуру. Вопрос решается так: убийцы живут – больные умирают.
Профилактика и растление
33. Сторонники священности жизни убийц любят говорить, что казни лишь способствуют жестокости нравов, но не останавливают потенциальных убийц. Обычно ссылаются на Средневековье. Но никто не в состоянии привести доказательств того, что при запрете на смертную казнь разгул преступности, вызванный отсутствием страха казни, не был бы куда больше.
34. Любой военачальник всегда знал: лишь казнь нескольких убийц и мародеров может быстро остановить убийства и грабежи в округе.
35. Знание того, что за убийство ты ответишь собственной смертью, неминуемой и страшной, многих способно остановить – это знает любой психолог.
36. Мягкость наказания растлевает. Ну, сяду. В тюрьме тоже люди сидят. А может, еще и выйду.
Судебная ошибка и гуманизм
37. Гораздо больше жертв пало от руки убийц, выпущенных из тюрем, чем вследствие судебной ошибки.
38. Повышение качества суда не должно зависеть от степени наказания.
39. Судебная ошибка должна караться настолько сурово, чтобы следственные и судебные органы были кровно заинтересованы избежать ее.
40. Гуманизм – это милосердие к жертве, а не к убийце.
