ТЕБЯ ПОСАДЯТ – А ТЫ НЕ ВОРУЙ
– Уголовный Кодекс надо чтить, - говорил своим «коллегам» еще «крестный отец» всех мошенников Остап Бендер. Но, если говорить серьезно, значение УК в жизни общества трудно переоценить. Со всеми законодательными актами государства с ним по значимости сравнима, пожалуй, лишь Конституция.
Потому понятен интерес к новому Уголовному кодексу России, который был принят 24 мая этого года, все это время находился в доработке и вступает в силу с 1 января 1997 года.
База сегодняшнего законодательства была создана в шестидесятых годах. О том, как изменилось общество за это время, говорить не приходится, потому новый Кодекс обществу просто необходим. За это время действующий УК дополнялся сотнями поправок и новыми статьями, но за временем угнаться не успевал.
Принципиальное отличие нового Кодекса проявляется, так сказать, и в идеологическом плане. Раньше важнейшим считалась охрана общественного имущества, строя и системы в целом. Новый Кодекс должен равно охранять все формы собственности, и частная собственность уже перестает быть «бедной родственницей». Во главу угла ставится защита личности, ее прав, имущества, здоровья и т.д. Преступление новый УК трактует кратко: «Преступлением признается совершенное общественно-опасное деяние, запрещенное настоящим Кодексом под угрозой наказания». Далее говорится, что малозначительные действия, не представляющие общественной опасности, преступлением не являются.
Многое из того, что раньше квалифицировалось как преступление, теперь таковым не будет, и наоборот. К разряду «новых» относятся экологические, экономические преступления в новых структурах, таких, как акционерные общества, товарищества с ограниченной ответственностью и прочих «ООО», незаконное участие должностных лиц в предпринимательской деятельности, оставление места ДТП нарушителем, нарушения в сфере компьютерной информации, значительно усиливается ответственность за преступления против правосудия. Статья 144 нового УК предусматривает ответственность за воспрепятствование профессиональной деятельности журналиста. Отменена статья за недонесение.
Вводятся новые виды наказаний – краткосрочный арест и направление на общественно-полезные работы на срок до 240 часов, ограничение свободы (не лишение) на срок до пяти лет, арест на срок до 6 месяцев.
Гораздо шире будут применяться штрафные санкции, а сумма штрафов возрастает до размеров от 25 до 1000 минимальных окладов.
Многое предусмотрено для того, чтобы «не сажать всех подряд» за что попало, не перегружать тюрьмы и не «портить» в них людей – за незначительные преступления, как уже говорилось, предусмотрены штрафы и краткосрочные аресты, больше возможностей для условно-досрочного освобождения и погашения судимости – это распространяется и на лиц, отбывающих наказание сегодня.
Срок изоляции от общества увеличен с 15 до 20 лет, в случае суммирования сроков – до 25 лет, а по совокупности приговоров – до 30 лет.
Одна из самых спорных и волнующих тем – смертная казнь. Что, например, делать с маньяком, лишившим жизни десятки людей, – держать пожизненно в тюрьме или казнить? Конституция РФ провозглашает право каждого человека на жизнь, но настрой общества, который, надо надеяться, учитывают законодатели, сегодня не столь лоялен.
Закон оставляет смертную казнь как исключительную меру наказания за особо тяжкие преступления против жизни. Смертная казнь может применяться в пяти случаях – убийство при отягчающих обстоятельствах, посягательство на жизнь государственного или общественного деятеля, посягательство на жизнь исполняющего правосудие или следствие, посягательство на жизнь сотрудника правоохранительного органа, геноцид. За эти же преступления возможно и пожизненное заключение. Эти меры не могут применяться к женщинам и мужчинам до 18 лет на момент совершения преступления и после 65 лет.
В режимах исправительных учреждений изменений не происходит. Самый «легкий» режим – колония-поселение, где отбывают наказание совершившие преступления по неосторожности, самый «крутой» режим – тюрьма за особо тяжкие преступления (свыше пяти лет и при особо опасном рецидиве). По мнению сотрудников правоохранительных органов, вводить в действие новый Кодекс будет довольно сложно. Например, отменяется понятие «телесные повреждения» и вводится понятие «вред» – тяжелый, средний и легкий. А нормативы классификации степеней тяжести вреда еще не определены, и эксперты после Нового года могут остаться просто без юридических документов.
