How Witnesses Should Act. Everyone can expect to be a witness in a trial. Testifying
under oath at a real trial can be a difficult experience. Television and movie trials do not
prepare witnesses for real trials. The following “rules” are common suggestions which may
assist witnesses and help the trial to be efficient.
First, tell the truth. A witness who lies under oath faces conviction for the serious
offense of perjury. If you do not know the answer to a question, say so. Do not make up
answers.
Second, be fair and objective. Your feelings should not affect your testimony.
Third, pay attention when you are testifying. You do not want to be viewed as indif-
ferent.
Fourth, if you did not hear the question or do not understand what a question means,
say so. The judge and jury are interested in what you know about the case. Do not be shy
about saying that you did not hear the question or that you do not understand.
Fifth, be courteous to everyone. Proper behavior develops mutual respect.

Як має поводитися свідок. Шосте, подумайте, перш ніж відповідати. Це надасть
вам час обміркувати питання та дати зважену відповідь. Якщо під час свідчення ви
припустилися помилки, скажіть про це відразу ж, як ви це зрозуміли.
Сьоме, відповідайте тільки на поставлені запитання. Якщо на питання можна
відповісти “так” або “ні”, відповідайте саме таким чином. Не вдавайтеся до додаткових
роз’яснень, не висловлюйте свою думку. Адвокати та суддя зажадають від вас
додаткову інформацію, якщо вона буде їм необхідна. Однак, якщо ви відчуваєте,
що відповідь потребує пояснення або що адвокат, який вас допитує, намагається
заплутати вас, ви можете попросити у судді допомоги та пояснень.
Восьме, тримайте себе в руках. Якщо ви вийдете з себе, адвокат, який допитує
вас, отримає велику перевагу. Більше того, навіть коли ваші свідчення є абсолютно
достовірними, вони можуть бути не взяті до уваги або навіть повністю вилучені, бо
може скластися враження, що вони ґрунтуються лише на емоціях.
Дев’яте, говоріть чітко, аби вас добре чули.
Десяте, вдягніться відповідно. Одяг та зовнішній вигляд залежать від
індивідуального стилю та фінансових можливостей. Якщо вам необхідна порада
стосовно того, як вдягнутися, запитайте адвоката або сторону, яка запросила вас
дати свідчення.
Одинадцяте, будьте самі собою. Не уявляйте себе конферансьє або естрадним
артистом, а суд – глядачами. Судовий процес – це не розвага, гумор тут
недоречний.
